WHEREAS, the City plnnning Commisaion did hold a publlc hearing et tha City Nell in the City of Anaheim on
OctOber 6, i969 at 2:00 o'clock P.M., notice of said public henring having been duly given as required by
lew end in eccorda~~t ~~ ~~ Provisions ~f the Anaheim Municlpel Code, Chapter lA.6R, to hear and consider evidence for
and ageInst seid proposed variance and to inventigete end meke findings end recommendetions in connection therewith;
and
WHEREAS, said Commission, efter due inspection, investigetion, end study mhde by itself and in its behelf,
and efter due conaldmation of ell evidence ond reporta offered at said hearing, does find and determine the following
fects:
1• That thepetltioner requests a vurience from the Anehelm Municlpel Code , a~ follows, to estabiish
a th*ee-story, 48-unit apartment complex on subject prooerty:

2• That waiver 1-a, above mentioned, is hereby approved on the basis that due to
z~ising land values. thouyht must be given to making additiona] air space more readii~
availabie to ~ake care of the increasing popu)ation.
3. That waiver 1-b, above mentioned, is hereby qranted on the basis that the property
~ owners basically affected by ±he proposed height had submitted ]etters indicating they
were not opposed to the three-story building; and that the properties affectud, are located
in an area planned for low-medium density residential development on the Preliminary General
Plan -• 1969.
4. That waiver 1-c, above mentioned, is hereby granted in part in that th~ 36-foot r?-
quired distance between the para.llel facing walls of the westernmost portior, or the buiiding
may be reduced t~ a minimum of 20 feetg and that the remainder of the waivers reqt~~st,~~+
ur.der 1-c above, are hereby denied since the petitioner stipulated to complying :~;itt~ Code
' requirements as they pertain to required distan~.es between bui]dings fo: the rernainder o!
the project.

and he stipulated to complying with Code requirements pertainin~ to pedestrian accessv:ays.
6. That the petitioner stipulated to eliminati.nq a11 m~indo~ras in the interior 8-foot
wide corridors.
%. That there are exceptional ur extraordinary circumstances or conditions applicable
t~ the property involved or to the intended use of the pz•operty thai do not ap~ly generally
to the property or class of use in the same vicinity and zone.
8. That the requested variance, as approved, is necessary ror the preservation and enjoy-
ment of a substantial property right oossessed by other proper~y in the sa~~~e vicinity and
zone and denied to the prcperi~- in question.
9. That the requested variance, as approved, will no~ be materially detrirnental to the
public welfare or injurious to the property or improvements in su<:h vicinity and zone in
~ which the property is located.
' N0~', THEREFORE, BE IT R~SOLVED that the Anaheim City Plannino Commission does tiereby
grant in part subject Petition for Uariance, upon the following conditions whic:}~ are hereby
found to be a necessary prer~quisite to t'he proposed use of the subject property in ord?r to
preserve the safety and general welfare of the Citizens of the City of Anaheim.
1. That this !•ariance is granted subject to the completion of Reclassification Na.
69-70-13.
~ 2. That subject property shall be developed substantially in accordznce with plans and
specifications on file with the City of Anaheim, marked Exhibit Nos. 1 and 2; provided, ho~;:-
ever, that any windows proposed in the interior corridors, where plans indica'te ~mindo~~~s
opposite each other, shall be deleted and blank walls provided; and :urther provided, that
pedestrian acce~sways between carporte and living ur.its shall meet Code requirements, as
stipulated to by the petitioner.
