PJHFREAS, as a result of recent requests within the City of Anaheim :or permission
to estabiish various types of "art•" theaters, the City Attorney recommended to the City
Planning Commissior~ proposals for d?letions and add:tior.s to Titie i8, o; the Aaaheim
1~unicipal Code relative to exhibition halls~ theaters, and auditoriums; anti
4VHEREAS, the City Planning Commission on October 6, 1969, directed tf:at a public
t~Earing be set for consideration of amendment.s to Title 18~ of the Anaheim ~dunicipal Code,
Chapters 18.40, G1, General Commerc:al~ G2, General Ccmmercie.l Zones~ and 18.G4,
Conditional Uses; and
WHEREAS, the City Planning r.ommission did hold a public hearing at the City ".all
in the City-of Ananeim on pctober 20, 1969, at 2:00 0'clock P.Pd., notice of public hearing
having been duly given as req~ired by law and in accordance with the pr.ovisions of the
Anaheim Munir,ipal Code, to hear and consider evidence ior and agair,st sai;l proposed
amendments and tu investigate and make findings and recommendations in connection there-
with; and
VJHEREAS, said Commission~ after due inspection, investigation~ and study made by
itself and in its behalf~ and after due c:onsideration of all evidence and reports offered
at said hearin~j, does find and determine the following facts:
1. That exhii;ition halls~ theaters, and auditoriums~ in tf~e commercial zones
should be considered as conditional uses in order to determine their appropriate-
ness to the area and to t5e City~ rather than permitting them by rioht in the
commercial zones.
2. That Section 18.40.020(c-12) - Permitted Service Businesses~ permits e:chibition
halls, theaters, and auditoriums as a matter of right in the C-1, General
Commercial, Zone.
3. That Section 18.44.010(15) - Use - permits theateis or auditor`ums as ~ ma~te:
of right in the G2, General Commercial, Zonc. -
4. That Chapter 18.48, Heavy Commercial Zone allows all uses perm`'.~d .n the C-
and G2 Zones~ and would, therefore~ by right allow exhibition hall=_, ',rE~~:,,,
artd auditoriums.
5. That Chapter 18.G4, Conditional Uses makes no rcference to the ~.-~s
ir: quest.iun,

NOW, THEREFORE, BE IT RE50LVED that the City Pianning Commission does h~reby
recommend to the City Council of the City of AnaFeim amendments to .itle :9, of the
Anaheim Municipal Code as follows, as deoicted on Exhibits A, B, and C, on ine basis
of the foregoing findingss
1) Delete Section 18.40.020(c-12);
2) Delete Section 18.44.010(15);
