A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF ANAHEIM GRANTING CONDITIONAL USE PERMIT
NO. 1202.
WHEREAS, the City Planning Commission of the City
of Anaheim did receive an application for a conditional use
pe~it from Bernardo Yorba, et al, 5440 Santa Ana Canyon Road,
Anaheim, California, 92806, owners; Calprop Corp. 1900
Avenue of the Stars, Suite 1400, Los Angeles, California, agent,
to establish a planned residential development with waiver of
maximwn building height within 150 feet of R-A (Portion A only)
on the following described property situated in the City of
Anaheim, County of Orange, State of California, to wit:
PORTION A:
A portion of Tract 936 per Book 30, Pages 1 and 2,
Miscellaneous !4aps in the City of Anaheim, County of
Orange, State of California, more particularly described
as follows:
Beginning at the southeast corner of said Tract 936;
thence along the southerly line of said Tract 936, North
890 12' 4511 lfest, 1944.66 feet to the southeast corner of
Lot 3 of said Tract 936; thence along the easterly line

AND i"lHEREAS, the City Plallning Conunission did consider
at its regular meeting on January 11, 1971 at the City Hall in
the City of Anaheim revised plans for said application; and
~mEREAS, said commission, after due inspection, inves-
tigation and studies made by itself and in its behalf and after
due consideration of all evidence and reports did adopt its
motion recommending approval of revised plans marked Exhibit No.
1, Revision No.1; and
~VHEREAS, the Cit~! Council had previously adopted its
Resolution No. 70R-574 denying Conditional Use Permit No. 1202,
upon request of t:ne petitioner, the City Council granted a
re-hearing upon said Conditional Use Permit and did fix the
19th day of January, 1971, as the time and the Council Chambers
in the City Hall of the City of lmaheim as the place for a public
hearing, and notices of SUCi1 public hearing were duly given as
re~uired by law and the provisions of Title 18 of the Anaheim
Municipal Code; and
WHEREAS, at the time and place fixed for said public
hearing, .the City Council did duly hold and conduct such hearing
and dici give all persons inter~sted therein an opportunity to
be ~eard and did receive evidence and reports; and
WHBREAS, the City Council finds, after careful con-
sideration of the reconunendat.ions of the Planning ComIllission and
all evidence and reports offered at said hearing that:

1. The proposed use, as revised, is properly one for
which a conditional use permit is authorized by
the Anaheim Municipal Code.
2. The proposed use will not adversly affect the adjoining
land uses and the growth and development of the area
in whic~ it is proposed to De located.
3. The size and shape of the site proposed for the use
is adequate to allow the full development of the
proposed use in a manner not detrimental to the
particular area nor to the peace, health, safety and
general welfare.
4. The traffic generated by the proposed use will not
impose an undue burden upon the streets and highways
designed and improved to carry the traffic in the area.
5. The granting of the conditional use permit under the
conditions imposed will not be detrimental to the
geace, health, safety and general welfare of the
citizens of the City of Anaheim.
NOW, THEREFORE, BE I'l' RESOLVED by the City Council of
the City of Anaheim that its Resolution No. 70R-574 be, and the
same is hereby rescinded, and that Conditional Use Permit No. 1202
be, and the same is hereby granted permitting the establishment
of a planned residential development on the property hereinbefore
described. .
That said conditional use pe~it be granted subject to the
following conditions~
1. That this conditional use permit is granted subject
to the completion of Reclassification No. 70-71-13.
2. The area designated in the plan as "special recrea-
tional area ii shall be developed as a pitch and putt
golf course or some other recreational use as approved
by the City Council, and its maintenance shall be
assured by contract or othe~lise to the satisfaction
of the City Attorney, construction to be commenced in
the third ?hase of development and completed in the
fourth phase of development of the to,.,nhouses under
Portion A.
3. Subject property shall be developed substantially in
accordance with plans and specifications on file with
the City of Anaheim marked Exhibit Nos. 1, (Revision
No. 2), 2, (Revision No.1) 1 3, 4, 5, 6, 7, 8 and 9;
provided that a maximum of 135 single-family dwellings
shall be developed in Portion B and a maximum of 331
townhoU3c units shall be developed in Portion A.
The City Cow1cil hereby reserves the right to revoke
SUCh conditional use permit for aood cause or failure of
said owners, their heirs, successors or assigns to comply with the
Anaheim Municipal Code and regulations and the conditions herein.
