THAT PETITION FOR VARIANCE NO. 2131 BE DENIED
~ - WHEREAS, the City Plenning Commission of the City of Ana}i~im did ceceive a verified Petition for Varience from
f GULF OIL CORPORATION, 666 East 17th Street, Santa Ana, California 92701, Owner; WILLARD L.
WEYLAND, 231 West Katella, Anaheim, California 92802, Agent of certain real property situated
in the City of Anaheim, County of Orange, State of Califorria, described as Lot 9 of Tract No.
3330 as sho~vn on a Map recorded in Book 113, pages 21 and 22 of Miscellanecus Maps, records
of Orange CoLnty. Except the Nertherly 100 feet thereof.

WHEREAS, the City Planning Commisalon did hold a publlc heering et the Clty Hall in the Clty of Aneheim on
; November 3, 1969, at 2:00 o'clock P.M., notice of said public hearing heving been duly given ea required by
1ew andin eccordaece with the provisions of the Anahetm Munlcipel Code, Chepter 18.68, to hear end consider evidence for

WHEREAS, sald Commisslan, efter due inspection, investigetlon, end study mede by ltself end in Ita behelf,
_, and efter due consideration of ell evidence and reports o[fered at seid heering, does find end detertnine the following

1. Thet the petltioner requeate e varience from the AneheIm Municipel Code , as fol lows s
SECTION 16.40.020 - Permitt~d uses in the C-1 Zone (establish autcmobile and motor-
cycle rentals in con,junction with an existing service station).
2. That the petitioner has not demonstrated that a hardship has been imposed upon him
wherein he is not able to enjoy the same rights and privileges enjoyed by other service
stations throughout the City.
3. That the petitioner is, in fact, requesting special privileges not enjoyed by other
service stations throughout the City.
4. That the petitioner proposed to park botti motorcycles and automobiles in the required
setback, if subject petitio~ were approved, thereby er,joying a right not qranted to the auto
rental agency immediately to the east of subject property.
5. That approval of subject petition would be setting a precedent for similar requests
from the more than 200 service stations throughout the City.
6. That service stations are now permitted to store a maximum of 10 rental trailers on
ttie service station site, and to permit the proposed use, in addition to the uses already
permitted at said sites, would promote the utilization of currently n~n-operating service
station sites or the conversion of operating service stations, to the vehicle rental busi-
ness and would create policing problems, since the officer could not destingu:sh between
rental vehiclea and customers' vehicles awaiting servicing.
7. That although the petitioner indicated that this service statiori site was located at
a very poor locatien and could not exist without some other type of business to add to the
revenue, the City is not responsible for rectifying poor business judg ments of the oil
companies.
8. That there are no exceptional or extraordinary circumstances or conditions aoplicable
to the property involved or to the intended use of the pzoperty that do not apply generally
to the property or class of >>se in the same vicinity and zone.
9. That the requested variance is not necessary for the preservation and enjoyment of a
substantial property right possessed by other property in the same vicinity and zane, and
denied to the property in qi~estion~

~ 10, That the requested variance will be materially det~imentai)to tne publi~ vm'.rare or
injurious to the property or irtiprovements in sucn vicinity and zone iT which the pruperty is
located.
• 11. That the Commission deems that auto rental agencies should only be permitted in the C-R,
C-0, and C-1 Zones by approval of a conditional use pe~~it.
