WHEREAS, thr City Planning Commisalon did hold a public hearing at the City Hell in the City of AnaheIm on

and egeinst seid proposed vorience end to investieete end meke findings end recommendations in connection therewith;

WHEREAS, eaId Commisston, efter due inspection, investlgetion, end study made by itself er.d In its behalf,
~~ and efter due consideratian of ell evidence and reports offered at seid hearing, does find and detennine the following
~ facts;

1. Thet the petitioner requests a verience from the Anaheim Municlpel Code as fol lows, to establ ish a
32-unit, single-story apartmer.t complex:
1. SECTION ]8.28.020 - Maxim~m number of inain buildinqs oer site. (2
permitted; 5 proposed). -
2. SECTION 18.28.050(6-a-1) - Minimum required front setback. (20 feet *e-
quired; 15 feet proposed).
3. S ECTION 18.28.050(7-•a) - Minimum distance between structures. (10, 18 and
28 feet reyuired; 8, 15, and 26 feet proposed).
2. That since the Commission has recommended denial of the reclassification of subject
proparty, the requested variance would not be applicable.
3. Tiiat there are no exceptional or extraordinary circumstances or conditions applicable
to the property involved or to the intended use of the property that do not apply generally
to the property or class of use in the same vicinity and zone.
4. That the requested variance is not necessary for the preservation and enjoyment of a
substantial property right possessed by other property in the same vicinity and zone, and
denied to the property in Guestion.
5. Thet the requested variance will be materially detrimental to the public welfare or
injurious to the property or improvements in such vicinity and zone in which the property
is located.
6. That four persons representing seven persons present in the Council Chamber, and a
letter and a petition signed by 31 property owners were received, all in opposition to
subject petition.

NOW, THEREFORE, BE IT RESOLVED thet the Anaheim City Planning Commission does hereby deny subject
Petition for Variance on the basis of the aforementioned findings.
