WHEREAS, the City Plenning Commission of the City uf Aneheim did receive a verified Petition [or Variance from

INCORPORATID, 2365 Westwood Boulevard, Los Angeles, Califo_nia 90064, qgent of certain
real property situated in the City of Anaheim, County of Orange, State of California,
described as Lot No. 3 of Tract No. 1245.
WHEREAS, the City Plonning Commission did hold e public headng et the City Hell in the City of Aneheim on
.; November 17, 1969, et 2:00 o'clock P.M., notice of seid public hearing heving been duly given ns required by

r_ WHEREAS, eetd Commisslon, after due inspection, investigetion, end study mede by itself and in its behelf,
and after duc considerotion of all evidence and reports offered at seid hearing, does find and determine the following
facts:
1. Thet the petltioner requests e verlance from ihe Anahetm Municipal Code. as follows, to permit the
~ expansion of a non-conforming use by the addition of one more aNartment unit on subject
; property:
i; a. SECTION 18.28,050(6-a-1) - Minimum repuired front setback. (20 feet adjacent
y to an arterial highway required; 12 feet proposed).

;. b. SECTION 18.28.050(7-a) - Ninimum distance between buildin s. (12 feet re-

: c. SECTiON 18.32.050(4-a) - Minimum required recreation-leisure area. (200

y 2. That aK:proval of subject petition would expand a non-conforming residential use in
an area planned and zoned for commercial developmen±.

p_titioner, by proposing an additional unit on the prop~rty, wouid be
f''~ reducing the usable open area used for recreational purooses to only 60% of the required
recreation-leisure area, and would be cr.eatinq an overdeveloped parcel.
I~ ~1. That the petitioner did not prove a hardship existed in the use of subject oroperty
;,~ to warrant favorable consideration of subject petition.
5. That •there are no exceptional or extraordinary circumstances or conditions appli-•
cable to the property involved or to the iritended use of the property that do not apply
generally to the property or class of use in the same vicinity and zone.
6. That the requested variance is not necessary for the preservation and enjoyrt~ent of
a substantial property .right possessed by other nroperty in the same vicinity and zone, and
denied to the property in question.
