WHEREAS, the City Planning Commission of the City oE Anaheim did receive a verified Petition for Con-
ditional Use Permit from ORANGE COUNTY WATER DISTRICT, 1629 West 17th S treet, S~nta Ana, California
92706, Ovaner; RUSSELL S. CLEARY, 1181 Flaninian Way, Santa kna, California 92705, Agent of
certain real property situated in the City of Anaiieim, County of Orange, State of California,
described as Lot 1, Lilocl: K of the Kraemer Tract of Oranae County, commonly known as the
Crill Basin. EXCEPTING IHEREFROM that portion thereof contained within the fenced area in
the southwesterly corner of said oroperty which is be'.~g used for District purposes.

WHEREAS, the City Planning Commission did hold e public hearing at the City Hell in the City of Aneheim
on December 29, 1969, at 2:00 o'clock P.M., notice o( said public hearing having been duly given
as required by laµ and in accordance with the provisions of the Aneiheim Municipal code, Chcipter 18.64, to hear
end consider evidence for and egainst said proposed conditional use and to investigate and make findings and
recommendations in connection therewith; and
WHEREAS, said Commission, after due inspection, investigatian, and study mede by ilselt end in its be-
halt, and nfter due consideralion of nll evidence and reports ofFered at said hearing, does find and detennine thc
following facts:
1. That the proposed use is properly one for which a Conditional Use Permit is euthorized by ~.o~'c:
~e;:tior. 18.64.020(5) to wit: to permi.t. on-sale beer i~i conjunction with the onerat~on
of a concession facility for .'ishing patrons on subiect property.
2. That the petitioner had not submitted evidence that there was a need for
the proposed use.
3. That a large portion of the patrons of the subject facil.ity are under the
age allowable for the consumption of alcoholic beverages, therefore, the use is
unnecessary.
4. That the eristing operation has been quite successful without on-sale beer,
and such sales would not be in the best interest of the under-age patrons.
5. That the grariting of the Conditional Use Permit will be detrirnental to the
peace, health, safety, and general welfare of the Citizens of the City of Anaheim.
6. That maintenan;e and cleanliness of the vaater of the Crill Basin (Anaheim
Lake) is essential to the health of the ci*_izens of the City of Anaheim, and the
introduction of emply beer cans, which the adult patrons would discard into the lake,
could create water pollution.
