Wl1EREAS, the City Planning Commis~ion at a public hearing on November 17, 1969,
granted Conditional Use Permit No. 1142 in Resolution tJo. PC69-229, subject to conditions;

V~HEREAS, ~he petitioner originally requested permission to expand the existing
trucking facility by incorporating approximately four additional acres into the ultimate
plans of deve.lopment for the total facility; and
WHEREAS, tne petitioner further requested v~aiver of the required 6-foot masonry
wall to enclose the outdoor use; and
WHEREAS, the Pianning Comrnission granted subject petitior~ in pa:t, namely the
expansion of the existing use; waiver of the masonry wall requirement along the north
and west boundaries; however, requiring the installatior of a chainlink fence with
metal slats instead of the masonry wall along said north and west boundaries; and
requiring that the 6-foot masonry wall be constructed imrnediately alony the south and
east property lines behind the requir~d setbacks; and
WHEREAS, the oetitioner has reque~ted an amendment to the conditions of approval
imposed by the Planning Commission in {~esolution N.o. PC69-229, on the basis that he
has no immediate plans for the developmint of all of tt~e southez•ly portion of the
property, and he has indicated that the masonry wall and street imp~•ovement reGuirements
along Coronado Street ~~ould create a difficult financial burden. especially in view
of the fact that he does nut know, at this time, ttie number or location of driveways
or wall openings that will be needed when the southerly two acres are de~~eloped; and

'. WHEREAS, the ~etitioner further requests in lieu of the metal slats in the cha~n-
link fence required by the Commission for the west and north property lines, he wished
to provide a landscape screen of trees and shrubs along these proparty lines; and
WHEREAS, staff has consulted with the Parkway Maintenance Division relative to
what type of landscaping would provide an effective screen if the required slattef~
- chainlink fence were deleted, and ~,vere advised by the Parkway Maintenance Superintendent
that a combination of Acacia Latifo].ia - on 10-foot cen+.ers - and Canary Island Pines -
on 30-foot centers - would provide an excellent screzn much higher than the 6-foot
chainlink fence; furthermore, he indicated that a minimum 6-foot wide plan~er area
with adeyuete irrigation facilities would be necessary to accommodate these plants; and
WfiEREAS, the staff further notified by letter all ;~roperty owners originally advised
regarding the public hearing of the request, in order that they might be apprised of the
req~aes~ted amendments and to present their comments; and
WHEREAS~ after due consideration of the requested amendments to the Commission's
original resolution, and additional comments by adjoining propert.y owners, the Commission
determinFd that the ]andscaping treatment along the west and northerly property lines
as recomrr.ended by the Parkway Mai.ntenancE, Superintendent would provide a more effective
screen that the slatted fence; furthermore, since the petitioner indicated t~e was not
proposing to develop all of the property at this time, it woulr~ be unnecessary ±o provide
th? ~r;asonry wall originally required along the Coronado Street frontage until such tin~e
as the remai.nder of the property is pr~posed for development, provided, however, that
the petitioner install a chainlink fence and the sar,ie landscaping treatment along the
souther]y boundary of the paved area to be developed at this time; and
WHEREAS, the petitioner stipulated to providing full street improvements along B]ue
Gum Street from the northerly boundary of subject property to Coronado Street.

NOW, THEREFORE, BE IT RESOLVED that the City Planning Commission on the basis of
the foregoing findings does hereby amend Resolution No. PC69-229, Condition Nos. 2, 9,
and 10, adding Condition I4os. 11, 12, 13, and 14, and restating Condition Nos. 1, 3,
4, 5, 6, 7, and 8, as originally approved'as follows:
1. That the owners of subject property shall deed to the City of Anaheim:a strip
of land 45 feet in width or Blue Gum Street. and 32 fe~t in width on Coronado Street,
from the centerline of the street, for street widening purposes.
2. That all engineering requirements of the City of Anaheim along Blue Gum Street
and Coronado Street, includirg preparation of improvement plans and installation of all
improvements, such as curbs and gutters, sidewalks, street grading and paving, drainage
facilities. or other appurtenant work shall be complied ~^rith as required by the City
Engineer and in accordan~? with standard plans and specifications on file in the cffice
of the City Engineer; that street lighting facilities alonn Blue Gum Street and Coronado
Street shall be installed as reGuired by the Director of Pub]ic Utilities; and that a
bond in an amount and form satisfactory to the City of Anaheim shall be posted ~vith the
City to guarantee the installation of the above mentioned requirements; pro~•ided, that a
bond may be posted to ensure the installation of said improvements along Coronado Street
at such time as the southerly portion of the property is developed.
3. That tra5h storage areas sha'_1 be provided in accordance with approved plans on
file vrith the office of the Director of Public V~orks.
4. That fire hydrants shall be instalied as required and determined to be necessary
by *he Chief of the Fire Department.
5. That all air-conditioning facilities shall be oroperly shielded from view.
6. That the existing structures shall be brought up to the minimum standards of the
Ci.ty of Anaheim, including the Uniform Building, Plumbing, Electrical, Housing, Mechanica]
and Fire Codes as adopted by the City of Anaheim.
7. That the entire area of subject pzoperty, excepting structure locations and re-
quired la~dscaping areas, shal] be paved prior to utiliz~tion of subject property for the
purposes granted under this conditiunal use oermit; provided, however, any portion of
subject property that is not to be used or developed for the activities granted herein
need not be paved unti] such use of such areas is conte++~plated; and further provided, that
a temporary barrier sufficient to prevent the movement of trucks and other vehicles from
paved areas to unpaved areas, shall be constructed alona tt~~e boundaries separating said
paved arezs from said unpaved areas in order to prevent the creation of an nuisance due
to dust.
8. That Condition Nos. 1, 2, 3, 4, 5, 6, and 7, above mentioned, she:l be complied
with N~ithin a period of 60 days from date hereof, or such other time as the Plannina
Comrnission or City Council shall determine.
9. That plans for the proposed service station at the northwest corner of Blue Gum
and Coronado Streets shall be presented to the Planning Commission for approval of plar.s
prior to the issuance of a building permit for said service stat?on, and that said s?rvice
station shall be developed substantially in accordance with the adopted Service Station
fti1inimum Site Development Standards; and further provided that any new structures in
additior. to the service station shal] conform to the City Courcil Metal Building Policy,
prior ~o :inal buildinc end zoning inspections.
lU. That subject ~roperty shall be developed substantially in accordance with plans
and specificat~ons on file with the City of Anaheim marked Exhibit No. 1, provided, hova-
ever, tnat a 6-foot masonry wall shal] be constructed along the Blue Gum Street frontage,
to the rear of the required setback, for the full distance of the property that is proposed
for dev~lopment at this time, within 60 days from date hereof; and that if any additional
property is developed southerly along Blue Gum Street, ,aid 6-foot masonry vaall shall be
extended southerly to Coronado Street as required by the Planning Commis<_ion.
11. That a bond in an amount and form satisfactory to the City of Anaheim shall be
postecl to insure the construction of a 6-foot masonry wall along the Coronado Street
frontaqe at such time as the remainder of the property is developed, said bond to be f::led
v;iti~ tne City witnin 60 days from date hereof.
12. That a minimum 6-foot wide planter area with adequate irrigation facilities, shall
be provided for the full distance of the west and north property lines, and that said
pJanter area shall be planted with 5-ga:lon Acacia l.atifolia planted on 10-foot centers and
15-qallon Canary Island Pines, planted between the Acacia shrubs, on 30-foot centers;

LSaintenanc~ Superintendent. Said landscaping sha]l be planted within 60 days from date
hereof ano shall be permanently maintained.

southerly boundary of the area proposed for irrmediate development -]ocated approximately

. 14. That a G-foot wide planter area with adequate irrigation facilities shall be
provided adjacent to said ch?i,^,iink fence, along the southerly boundary and said planter
area shall be planteu with 5-gallon Acacia Latifolia planted on 10-foot centers and 15-

more, that said landscape planting shall be subje~t to the approval of the Parkway Mair.ten-
ance Superintendent. Said landscaping shall be planted within 60 days from date hereof and
