THAT PETITIGN FOR CONDITIONAL USE PERMIT N0. 1095 BE GRANTED
WH~~`'AS, the City Planning Commission of the City of Anaheim did roceive a verifietl Petition for Conditional
Use Permit from ANNE H~ENNING PAULUS, 2420 East La Palma Avenue, Anaheim,. Ca'_ifornia 92806, Owner;
EUG,ENE F. 0'Neil., 2910 East Trenton Avenue, Orange, California 92667, and LEOhARD SMITH, 125-D
South Claudina Street, Anaheim, California 92805, Agents of certain real pr~perty situated in
the City of Anaheim, County of Orange, State of California, described in Exhibit "A" attached
hereto and referred to hereir, as though set forth in full.

;i WHEREAS, the City Planning Commission did hold a public hearing at the City Hell in the City of Anaheim on
% February 26~ 1969~ at 2:00 o'clock P.M., notice of seid public hearing heving been duly given as required by
law and in eccordence with ffie provisions of the Anaheim Municipal code, Chapter 18.64, to hear end consider evidence
; for end agair.st said proposed rnnditional use and to investigate end make findings and recommendations in connection

:1 WHEREAS, said Commission, after due inspection, investigation, end study mode by itself and in its behalf, and
after due consideration of all evidence and reports offered at soid hearing, does :ind and detennine the following facts:
1. Thet the proposed use is properly one for which o Conditionel Use Petmit is authorized by Cod e
Section 18,40.060(e) to wit: establish a walk-up restaurant on subject property.

; 2. Thet the proposed use will not adversely affect the adjoining land uses and the growth end development of
• the area in which it is proposed to be located.
"~ 3. That the size and shape of the site proposed far the use is adequete to allow the fuli development of the
pmposed use in a manner not detrimental to the particular orea nor to the peace, health, safety, end general welfare of
the Citizens of the City of Anaheim.
4. Thet the granting of the Conditiona! Use Peimit under the conditions imposed, if any, will not be detrimentel
to the peece, health, sefety, and general welfare of the Citizens of thc City of Aneheim.

2. That any parking area lighting shall be lighted with down-light~.ng a maximum 6-feet in
height and shall be directed away from the property lines to protect the residential integrity
of~the area, prior to final building inspection.
3. That subject property shall be developed substantially in accordance with plans and
specifications on file with the City of Anaheim, marked Exhibit Nos. 1, 2, 3, 4, 5, 6, 7, and
8.
