2. That the requested waiver of maximum building height within 150 .~At of the single
family residential subdivision to the north is hereby granted on the basia that the pE~.i~ion~r
indicated that there would be no windows in the walls facing the subdivision, and t;~e
Commission f elt that R-2-5000 subdivisi.ons need not be afforded the same protectior. as R-l
subdivisions.
3. That tlie minimum number of required covered parking spaces is hereby waived on the
basis that the Commission feels that some open parking should be encouraged for use by guests
and the petitioner has provided an excess of parking, both covered and open combined, ove:
the minimum required.
4. That there are exceptional or extraordinary circumstances or conditions applicabie
to the property involved or to the intended use of the property that do not apply generaily
to the property or class of use in the same vicinity and zone.
5. That the requested variance is necessary for the preservation and enjoyment of a
substantial property right possessed by other property i~ the same vicinity and zone, and
denied to the property in question.
6. That the requested variance will not be materially detrimental to the public welfare
or injurious to the property or improvements in such vicinity and zone in which the p:operty
i~ located.
7. That the petitioner withdrew the request for waiver of the minimum distance bctween
buildings and stipulated to meeting Code requirements.

grant subject Petition for Variance, upon the following conditions vahich are hereby found to be
a necessary prerequisite to ;:he proposed use of the subject property in order to pr~sei•ve the
saf ety and general welfare of the Citizens of the City of Anaheim.
1. Tha~t this variance is gran~ed subject to the completion of Reclassification No.
68-69-49.
2. That trash storage areas shall be provided in accordance with approved plans on
file with the office of the Director of Public Works.
3. That fire hydrants shall be installed as required and determined to be necessary by
the Chief of the Fire Department.
4. That a 6-ioot masonry vaall shall be constructed along the east property lir.~
adjacent to the R-1 zone~ properties.
5. That any air-concitioning facilities proposed shall be properly shielded f:om vi~w,
and the sound shall be buffered from adjacent residential homes.
6. That Conditien Nos. ?_, 3, 4, and 5, above mentioned, shall be complied ~Nith prior
to final building and zonir,g in=pections.
7. That the owner of subjec~t property shall pay to the City of Anaheim park and re-
creation fees for each dwelling unit as required by City Council resolution, which shall be
used for park and recreation purposes, said amount to be paid a~ 'he time the Building Permit
is issued. '
S. That subject property shall be developed substantially in accordance with plans and
specifications on file ~Nith the City of Anaheim, marked Exhibit Nos. 1, 2, 3, a, 5, ano 6,
provi.ded, however, that the rtiinimum distanr,e between buildings shall be in conformance v~ith
the R-3 site development standards, as stipulated to by the petitioner.
