at the North West corner of the property as sho;vn on the Plot Plan submitted to the City of

WHEREAS, the City Planning Commission did hold a public hearing at the City Hall in the City of Anaheim on
March 24~ 1969~ at 2:00 o'clock P.M., notice of said public hearing having been duly given as required by
lew end in eccordance with the provfsions of the Anaheim Municipal code, Chapter 18.64, to hear end consider evidence
for and ageir.st seid proposed conditionel use end to investigate and meke findings end r~commendations in connection
therewith; a~d
WH.E'REAS, said Commission, after due inspectlon, investigetion, end study made by itself and in its behelf, and
after due censideration of all evidence and reports ofEered at said hearing, does find and detertnine the following facts:
1. That the ro os~d use is p:operly one for which o Conditionel Use Permit is authorized by Code:
Section 18,40.060gy~ to wit: permit on-,ale beer and wine in conjunction with a oroposed
restaurant, with waiver of:
SECTION 18.40.070 3-a - Interior side vard setback. (24-fei;t required; 0-feet
proposed).
2. Thet the proposed use will not edversely affect the ndjoining land uses and the growth and devclopment oE
the area in which it is proposed to be located.
3. That the size and shape of the site proposed for the use is edequate to allow the full development of the
pmposed use in e menner not detrimental to the perticuler erea nor to the peace, health, safety, and general welfare of
the Citizens of the City of Anaheim.
4. That the granting of tfie Conditionel Use Pertnit under the conditions imposed, if eny, will not be detrimental
to the peace, health, sefety, end qeneral welfere of the Citizens of the City of Aneheim.
5. That the Plannir,g Commission was of the opinion that the undeveloped properties
fronting State College Boulevard would develop for commercial land use and thereiore, the
interim side yard setback would be technical in nature.
6. That a letter was received in opposition.

NOW, THEREFORE, BE IT RESOLVED th~t the Aneheim City Plenning Commission doea hereby grant subJect
Petition [or Condltionel Uae Permit, upon the following condItione which ere hereby [ound to be a neceasary prerequisite
to the proposed use oE the eubject property 1n osder to preserve the aaEety end generel welfare of the Citizens of the
City of Annheim:
1. That this conditional use permit is granted subject to the completion of Reclassi-
fication No. 68-69-78.
2. That a temporary barrier shall be erected along the easterly boundary of the
proposed paved parking area to prevent individuals from driving their vehicles into the
unpaved area which remains undeveloped for an indefinite period and creating a nuisance
situation for the adjacent residents. This varrier shall be erected prior to final building
inspection.
3. That subject property shall be developed substantially in accordance with plans
and specifications on file with the City of Anaheim,.marked Exhibit Nos. 1, 2, and 3.
