A~ , end ;?J WHEREAS, the City Planning Commission did hold e public hearing at the City Hall in the Cfty of Anaheim on ::~ April 7, 1~69~ at 2:00 o'clock P.M., notice of said public hearing having been duly given as required by law and in accordance with the provisions of the Anaheim Municipal code, Chepter 18.64, to hear and consider evidence ~ for and ageir.st said proposed conditional use and to investigate and meke findings and recommendations in connection ; ; y therewith; and r_ WHEREAS, said Commission, after due inspection, investigation, end study mede by itself and in its behalf, ~~9 after due consideration of all evidence and reports offered at said hearing, does find and detertnine the following fac ,: 1. That the proposed use is properly one for which a Conditional Use Pennit is authorized by Code: Section 1II,52.050(a) to wit: establish a towing service with temporary outdoor storage of wrecked and impounded vehicles on subject property. { .; ~ :; I `. ~ I 2. That the proposed use will not adversely affect the adjoining land uses aiid the growth and development of f the area in which it is proposed to be located. ~ 3. That the size and shape of :he site proposed for the use is edequute to allow the full development of the j;'' proposed use in a manner not detrimental to the particular area nor to the peace, health, safety, and general welfare of the Citizens of the City of Anaheim. ~.; 4. That the granting of the Conditional Use Peimit under the conditions imposed, if any, will not be detrimental i/ to the peace, health, safety, and general welfare of the CiGzens of the Ci`y of AnahPim. ~:, 5. That the petitioner stipulated to the requirement that vehicles would not be moved to or stored on the southerly portion of subject property where adjacent to the single family residences between the hours of 5 p.m. and 7 a.m. I,s 6. NOW, THEREFORE, BE IT RESOLVED t.het the Aneheim City Planning Commissbn does hereby grant subject Petition for Conditionel Use Petmit, upon the following conditions which are hereby Eound to be a necessery prerequisitc to the proposed use of the subject pcoperty in ordet to preserve the sefety end general velfere ofthe Citizens of the City of Aneheim: 1. That tha owners of subject property shall deed to the City of Anaheim a drainage easement over the south~*ly 10 feet and the southeasterly 10 feet of subject property. 2. That trash storage areas shall be provided in accordance with ap~roved plans on file with the office of the Director o: Public Works. 3. That any parking or storage area lighting shall be lighted with down-lighting a maximum 6-feet in height and shall be directed away from the property lines to protect the residential integrity of the area to the south. 4. ihat Condition Nos. 1, 2, and 3, above mentioned, shall be complied with orior to final building and zoning inspections. 5. That there snall be no stacking or dismantling of vehicles on the property as stipulated to by the petitioner. 6. That no cars shall be moved to or stored adjacent to the sir.gle-;amily tract located to the south of subject property between the hours of 5:00 p.m. and 7:OC a.m,, as stipulated to by the petitioner. 7. That subject property sha11 be developed substantially in accordance with plans and specifica{:ions on file with the City of Anaheim, marked Exhibit Nos. 1 and 2, provided, how- ever, that the seutherly property line s.hall be fully screened with trees on 2C-foot centers to hide the stored vehicles from view from the future residents to the south; and, that the entire outdoor storage area shall be fully blacktopped, THE FOREGOING RESOLUTION is signed and appro~ed by me this 17th day of April, 1969.
