PC 69-83~ ~~i RESOLUTION N0. pC69-83 A RESOLUTION OF THE CITY PLANNING COMMISSIOt~ OF TfiE CITY OF ANAHEIM THAT PETITION FOR VARIANCE NO. 2073 gE DE,NIED WHEREAS, the City Planning Commission of the City of Anaheim did receive a verified l~etition for Varience from AL STOVALL, ET AL, 1717 South Harbor Boulevard, Anaheim, California 92802, Owner; JACK STOVALL, 1717 South Harbor Boulevard, Anaheim, California 92802, Agent of certain real property situated in the City of Anaheim, County of Orange, State of California, d~cribed in Exhibit "A" attached hereto and ref erred to herein as though set forth in full. ' ~ '~ ; and WHEREAS, the City Planning Commission did hold e public hearing at the City Hall in the City of Anaheim on April 21, 1969 et 2:00 o'clock P.M., notice of seid public hearin hevin been dul lew end in accordance with the provisions of the Aneheim Municipal Code, Chepter 18.68, to hear and cons der evidence for end egsinst said proposed varience end to investigete end make findings end recommendetions in connection therewith; and WHEREAS, seid Commission, efter due inspection, investigetion, and study made by itself and in its behelf, and efter due consideration ot ell evidence end repods offered at seid heering, does find and detecmine the following fects: 1. That the petitioner requests e veriance from the Anaheim Municipel Code as fol!otvs, to permit tt~e construction of a free-standing sign on subject property: (a) SECI'ION 18.62.C90(B-2) - Maximum he~qht of a free-standinq siQn. ~- (25 feet permitted when within 300 feet '~ `; of any residential structure; 60 feet ~ ' proposed). _ ~b) SECTION 18.62.090(B-4-c) - Maximum displav area of a free-standinq si n(350 square feet per face permitted; , 425 square feet per face propused). 2. That the petiti~ner ~id not submit evidence that a hardship existed proving that signing within Code requi-ements wauld be detrimental to the proposed devalopment. ! 3. That signing for other similar facilities within 300 feet of residential uses have been required to meet Code requirements, and to grant the proposed 60-foot high sign would be grantinq a privilege not enjoyed by other motel developers. That the approval of subject petition will set an undesirable precede~t for a I similar request from the proposed :estaurant which will be located at the northeast corner of subject property. ~:: S, 5.
