A RESOLUTION OF THE CITY PLANNiNG COMMISSION OF THE CITY OF ANAHEIM
THAT PETITION FOR CONDITIONAL USE PERMIT 109g BE DENIED
Wf[EREA$, the City Planning Commicsion of the City of Anaheim did receive a verified Petition for Con-
ditional Use Permit from ~C6EPH I7. HUARTE, 1464 East La Palma Avenue, Anaheim, California 92805,
Owner; 4ENRY REICHEl2T, 16262 East Whittier Boulev2rd, Whittier, Californ.ia 90603, Agent of
certain real property situated in the City of Anaheim, County of Orange, State of Californiz,
described in Exhibit "A" attached hereto and referred to herein as though set forth in
full.

YlFIEREAS, the City Plannine Commission did hold a public hearing at the City Hall in the City of Anuheim
on May 5, 1969, at 2:00 o'clock P.M., notice of snid public hearing heving been duly given
as required by law and in ~ccord~nce ait6 the provisions of the Aneheim Municipal code, Chepter 18.64, to hear
and conaider ~vldoncs for md aiainat saiJ proposed conditIonal use and to investi¢ote and meke findings and
recommendetione in connection therewith; ond
WHEREAS, eaid Commission, after due inspection, investigetion, and study mede by itself and in its be-
; helf, attd aCter due consideration ef ell evidence ~nd reports offered et seid hearing, does find end determine the
foilowln` f^cts:
i. That the propoaed uee is properly one for which a Conditional Uae Permit is authorized by Goc;e:
Section 18.64.020(2-d) to wit: establish a 182-space mobile home park, with waive=
of the minimum required setbacks on subject property.
2. That the proposed use will adversely affect the adjoining land uses and the
growth and development of the area in which it is proposed to be located.
3. That the granting of s~.;bject petition would be establishing a precedent by
granting a privilege not enjoyed by developers of adjoining properties who were re-
qui~ed to develop in accordance with General Plan Amendment No. 97, by providing a
tier or 7200 square foot R-1, One Family, Zoned lots abutting the existing R-1 sub-
divisions, then transitioning to low-medium and medium-density; whereas, the petitioner
is proposing to totally develop subject property with a mabile home park which is
considered in the 1,flw-medium e~ensity category.
4. That the commitmer,t made by the Planning Coramission and City Council after
numerous public hearings, to assure the existing single family home owners in the
area some protection from more intense land uses cf vacant properties in an area
bounded by Frontera Street on the north, Rio Vista Street on the west, Lincaln Avenue
on the south, and Kraemer Boulevard on the east, snould be honoreci since the integrity
of the City is involved.
5. That n~ land use change hae taken place in the past four months to ~varr.~nt
favorable consideration of another Generai Plan Amendment, and no evidence was sub-
mitted to warrant favorable conside:ation o: subject petition.
6. That three persons a~peared at three separate public hearinos, representing
a number tlf persons pse~snt. in the Council Chamber in opposition to subject petition.
