A RESOLUTION OF THE CITY PLANNING COMMISSION OF THE CITY OF ANAHEIM
THAT PETITION FOR CONDITIONAL USE PERMIT 1187 gg GRANTED
j WHEREAS, the City Planning Commission oE the City of Anaheim did receive a verified Petition for Con-
ditional Use Permit from CARRIE MC CLURE~ % LEONARD SMITH REAL ESTATE, 125-D South Claudina
' Street, Anaheim, California 92805, Owner; LEONARD SM:TH, 125-D South Claudina Street,
Anaheim, California 92805, Agent of certain real property situated in the City of Anaheim,
County of Orange, State of California, described in Exhibit "A" attached hereto and referred
to herein as though set torth in iull.
; and
WHEREAS, the City Plenning Commission did hold a public hearing et the CityHall in the City o( Anaheim
on June 2°, 19~0~ et 2:00 o'clock P.M., notice of said public hearing having been duly given
as required by law and in eccordance with the provisions of the Anaheim Municipal code, Chapter 18.64,to hear
end consider evidence for and against said proposed conditioual use end to investigote and make Eindings and
recommendetions in connection therewith; end
WHEREAS, said Commission, efter due inspection, investigation, and study made by itself and in its be-
half, end after due considetation of all evidence and reports offered at said hearing, does find and determine the
following fects:
1. That the proposed use is properly one for which a Conditionel Use Permit is euthorized by Code:
Section 18.a0.060(h) to wit: establish a plant nursery and related uses, with waivers
of:
a. SECTION 18.40.070(2-a-°-a) - Minimum reauired setback adiacent to a
residential zone. (10 feet required; 0 feet
proposed).
b. S ECTION 18.40.070(3) - Maximum nermitted buildinq heiqht. (2:1 set-
ba _ck required from single family uses within
150 feet, or 20 feet, required; Q~ proposed).
2. That the petitioner withdrew Waivers 1-a and 1-b, above mentioned, and stipulated
that the proposeci buildings would be located so as to conforr~ to the City of F,nai~eim ~~ning
and &uilding Codes.
3. That the proposed use will not adversely affect the adjoining land uses and the
gruwth and development of the area in which it is proposed to be located.
4. That the size and shape of t:~e sit? proposed for thE t~se is adequate to allow
the full development of the proposed use in a manner not detrimental to the particular
area nor to the peace, health, safety, and qeneral welfare of the Citizens of the City of
Anaheim.
5. That the granting of the Conditional Use Permit under the conditions imposed, if
any, will not be detrimental to the peace, health, safety, and general welfare of the
Citizens of the City of Anaheim.
6. That the petitioner stipulated to a one-ton weight limit for delivery trucks
which may use the east drive, thereby assuring protecCion for :he residents to the east.

NOVJ, TN[REFORE, BL- IT RESOLV[D that the Anaheim City Planning does her~by yrant subject
Petition for Conditional Use Permit, upon the follovrinq condition_ which are hereby found to be a
necess~ry prerequisite to the proposed use of the subject property ~n order to preserve the
safety and general wel:are of the Citizens of the City of Anaheim.
1. That the owner of subject property shall deed to the City of Anaheim a stri~ of land 53
fee: in width from the centerline of the street along Lincoln Avenue, for street widening purposes.
2. That the owner of subject property shall pay to the City of Anaheim the sum of 15Q per
front foot along Lincoln Avejue, for tree plantinq nurposes.
3. That the owner of subject property shall pay to the City of Anaheim the sum of $2.00 per
front foot along Lincoln Avenue, for street lighting purposes.
4. That the sidewalks and driveways shal: be installed along Lincoln Avenue as required by
the City Engineer and in accordanc~ with stzndard plans and ~necifications on file in the office
of the City En9ineer.
5. That trash storaoe areas shall be provided in accordance with apnroved plans on file with
the office of the Director of Public VJorks.
6. Chat fi:e n•ydrants shai] be installed as required and determir,eo to be necessary by the
Chief of the Fire Department.
~. That subject property shal] be served by underground utilities.
8. That a 5-foot masonry wal] =_hall be cons±ructed alonn the east and south pronerty l:nes.
9. That all air-conditioning facilities shal] be properly shielded from vie~v.
10. That any parF:ing area lignting proposed shal] be dovm-lighting of a maximum heignt of
b-feet, which liqhting shall be directed away from the property lines to protect the residential
integrity of 'he area.
11. That the eYistiny structure shall be brought up to ti~e rnirimum s~andards or' the City of
Nnaheim, including the Uniform Building, Plumbing, Llectrical, iiousing, '~1echanical and Fire Codes
as adopted by the City of Ananeim.
12. That t;~e fina] parl:ing plan sha11 be approved by the Development Services Department, and
any landscaped ar?as in the par~inq area shall be protected v~ith 6-inch high, r_oncrete curb„ and
concrete wheel stops sha]] be provided for par~:ing spaces as required by the Developmen: °er.vices
Department.
13. Tnat subject property shall br- developed substantially in accordance vrith plans ar~d s~eci-
fications on file •nith tiie City of Anatieim, marked [xhibit t1os. 1 and 2, provided, however, that
the proposeo buildinys will conform to Code required set~acks.
14. That Condition Nos. 1, 2, and 3, above mentioned, shall be complied with prior to the
comrnencement of the activity autt~orized under th3.s resolution, or prior to the time that the
buildiny nermit is issued, or within a period of 180 days from date hereof, whichever occors first,
or such further time as tne Planning C~mmission may grant.
15. That Condition Nos. 4, 5, G, 7, 8, 9. 10, 11, 12, and 13, above mentioned, shall be
complied viith prior to final building and zoning inspections.
