WHEREAS, the City Plonning Commisaion dtd hold e public heering at the City Hell in the City of pnaheim on
February 99 19?09 et 2:00 o'clock P.M., notice of seid public hearing heving been duly given es required by
law and in eccanlence withthe provisions of the Anaheim Municipal Code, Chapter 18.68, to hear and consider evidence for
and ageinst said proposed vetience and to investigate end meke findings and recommendetions in connection therewith;

1. Thet the petitioner requests a verience from the Anaheim Municipal Code as fol low=_ 9 to replace an
existing free-standing sign on subject property:

setback permitted; 130 square feet proposed).

d. SECTION 18.62.090(B-~) - Location of a f.~ee-standinq siqn. (Minimum of 120 feet
from adjacent property line required; 70 feet pro-
posed).
2. That there are exceptional or extraordinary circumstances or conditions applicable
to the property involved or to the intended use of the property that do not apply generaliy
to the property or class of use in the same vicinity ar.d zone.
3. That the request?d va:iance is necessary for the p*eservatior. and enjoyment of a
substantial property right possessed by other property in the same vicinity and zone, and
denied to the property in question.
4. That the requested variar,ce will not be materially detrimental to the oublic ~~elfare
or injurious to the property or improvements in such vicinity and zone in which the property
is located.
~, 5. That the proposed sign is basically a replacement for an existing s~gn, and the owner
of the total property involved did not consider the request detrimental to th~e property, other
tenants, or the surrounding area, and therefore, was in agreement with the proposal,

NOW, THEREFORE, BE IT RESOLVED that the Anaheim City Planning Commission does hereby grant subject
Petition for Veriance, upon the following conditions which are hereby found to be a necessary prereqaisite to the pro-
posed use of the subject property in order to preserve the safety and generel welfare of the Citizens of the City of
Anaheim.
1. That adequate clearance of existing electrical lines shall be provided as required
by the Electrical Divisior, Department of Public Utilities, and the State of California
G.O. 95.
2. That subject property shall be developed substantially in accordance with plans
a~~d specifications on file with the City of Anaheim, marked L•xhibit Nos. 1., 2, and 3.
3. That the existing free-standing sign located near the east prooerty line of subject
property shall be removed within ten (10) days from tha completion of the nevr sign granted
under this resolution.
