A RESOLUTION OF TBE CITY PLANNING COMMISSION OF THE CITY OF ANAHEIM
THAT PETITION FOR VARIANCE N0. 2150 gg APPROVED Iid PART
WHEREAS, the City Planning Commiasian of the City of Aneheim did receive e verified Petition for Varience from
5AM DOMINO, 8372 Centr.al Avenue, Garden Grove, Cal.ifornia 92641, Owner of certain real
property situated in the City of Anaheim, County of (7range~ State of California, described
in Exhibit "A" attached hereto and referred to herein as though set forth in rullo
WHEREAS, the City Planning Commieaion did hold a public hearing et the City Hell in the C'rty of Aneheim on
j February 99 1970~ et 2:00 o'clock P.M., notice oE seid public hearing having been duly given as required by
~ lew end in eooocdenee tvith the provisions of the Anaheim Municipal Code, Chepter 18.6E, to hear end considet evidence for
and egainst aeid proposed variance end to inveatigete and make findings end recommendetions in connect3on therewith;
~ and
WHEREAS, naid Commission, efter due inepection, investlgetion, and study made by itself and in lts behalf,
and efter due consideration of ell evidence ond repoRs offered at seld hearing, does find and detercnine the following
fects:

i 1. T'het the petltioner requeate e varlence ft~m the Anahelm Municipel Code as follows ~ to establish a
52-unit motel in conjunction with an enclosed res#aurant on subject property:
a. SECTION 18.85.010(A) - Minimum special structural setback. (35 feet re-
quired on Harbor Aoulevaxd; 20 feet proposed).
;. b. SECTION 18.85.010(A) - Minimum special landsr.ape setbacF:. (39 feet required
on Harbor Boulevard; 20 feet proposed).
c. SECTION 18.37.040(B-1! - Number of fr.ee-stan~'inq siqns. (1 permitted; 2
proposed within 300 feet of each other).
d. SECTION 18.37.040(B-4) - Location of free-standina sictn. (92 feet from
adjacent property lines required; 45 feet and 70 feet
from adjacent property lines proposed).
2. 'Iha~ the petitioner withdrew Waivers 1-c and 1-d, above mentioned, and stated that
either a parcel map would be filed for approval, or an integrated free-standing sign
advertising both us?s and in conformance with Code, would be constructed, thereby eliminating
the necessity for said waivers.
~. That the petitioner submitted the required evidence that the requested waivers of
structural and landscape setback were necessary due to the unusual wedge-shape of subject
oroperty, and the fact that other commercial uses in the area have setbacks similar to those
proposed.

4. That tliere are exceptional or extraordinary circum9tances or conditions appiica~!e
to the oroperty involved or to the intended use of the proper.ty that do not app=y generally
to the property or class of use in the same vicinity and zone.
5. That the requested variance is necessary for the preservation and enjoyment o: a
substantial property right possessed by other property in the same ~~icinity and zone and
denied to the property in question.
6. That the requested vari.ance will not be materially detrimental to the public welfare
or injurious to the property or improvements in such vicinity and zore in which the property
is located.
NOW, THEREFORE, BE IT RESOLVED thzt the Anaheim City Planning Commission does hereby
- grant subject Petition for Variance, uoon the following conditions which ar? hereby found to
,...~i~ be a necessary prerequisite to the proposed use of the subject property in orde~ to preserve
ti~ the safety and general welfare of the Citizens of the City of Anaheim.
1. Tha~~ thi.s variance is granted subject to the completion of Reclassification t~o.
~~ 66-67-61, now pending on subject property.
~ 2. That street lighting facilities along Harbor ~oulevard shall be installed as :equired
j by the Director of Public Utilities and in accordance with standard plans and specificatiors
~ on file in the office of the Director of Public Util:ties, and that a bond in an amount and
~ form satisfactory to the City of Anaheim shall be posted with the City to guarantee the in-•
~ stallation of the above mentioned requirements.
~ ~ 3. That fire hydrants shall be installed as required and determined to be nec.essary by
I• the Chief of the Fire Department.
I 4. That subject property shall be served by underground utilities.
5. That Condition Nos. 2, 3, and 4, above mentioned, shall be complied with prior to
j final building and zor~i,~g inspections.
i 6. That subject property shali be daveloped substantially in accordarce with plans and
i specifications o^ file with the City of Anaheim, marked Exhibit Nos. i, 2, 3,Iand 4.
