WHEREAS, the Clty Plenning Commissio~n of the Ctty of Aneheim did ceceive a verified Petition for Variance from
D. PAUL HUFFMAN, 1900 Prairie Street, Elkhart, Indiana 46515, Owner; L'J. h1ICHALSKI,
M. AND N. APARTMENIS, 254 Rio Grande Avenue, Placentia, California 92670, Agent of cerLain
real property situated in the City of Anaheim, County of U~ange, State of California,
described as the Southerly 185 feet oi the Northerly 251 feet of the West half of the
Northeast quarter of the Northeast quarter of Section 17, Township 4 South, Range ]0 :~Jest,
in the Rancho Los Coyotes, as the No:th halt of the No:th half of said Section 17, is
shown on a map of Tract No. 2299, recorded in Book 70, pages 44 to 49 inclusive of
Miscellaneous Maps, in the office of' the county :ecorder of said county. EXCEFT the

WHEREAS, the City Planning Commienion did hold e public hearing at the City Nell in the City of Aneheim on
Augus t 24, 1970, et 2:00 a'clock P.M., notice of seid public hearing heving been duly given es required by
lew andin accorden¢e with We ptovisions of the Anoheim Municipel Code, Chepter 18.68, to hear and consider evidence for
and against seid ptoposed varlence end to inveotieete end meke findings and recommendetiuns ln connection therewith;
and
WHEREAS, said Commiaslon, efter due inapectlon, lnvestigetion, end study mede by itself and In Its behelf,
end efter due canxidmation of all evidence and reports offered at seid hearing, does find and detecmine the fallowing
fecte:
1. 1'hat the petitioner requeats e vetfance from the Aneheim Municipel Code, as fol lOws, to eatabl isli an
existing sign as a legal sign on subject property:
a. SECTION 1$.62.090(a) - Repuirement that a sinn be located on the premises
beinq advertiseo. (The proposed sign is located on
a separate parcel of property).
b. SECTION 18.62.09U(Fi-1) - IJumber of free-standinr, sians neriri~_ted. (1 sion

?_. That waivers 1-a, 1-b, 1-c, i-d, and 1-Py above mentioned, are hereb, qranted f~r a
period of three years on the basis that due to the access situation ap~licable 'o tho ,'-3
property, there would be no other way to advertise the apartment devclopment.
3. That the existing siqn ~hzll be permitted for a period of t}see years at its present
height and location.
4. ?hat there are exceptional or er,traordinary circumstances or conditions applicaul~

is located.
7. That the petitioner stipulated to removal of the existing "Incon~e I'ax" si~n immedi-
ately adjacent to the approved sign, and that the existing roof signs would be removed aiter
the three year time limitation.

NOW, THEREFORE, BE IT RESOLVED that the Anaheim City Planniny Commission does nereby
grant subject Petition for Variance, upon the following conditions which are hereby found to
be a necessary prerequisi~e to the prooosed use of the subject property in order to pre=erve
the safet;~ and general welfare of tfie Citizens of the City of Anaheim.
1. That subject property shall be developed substantially in accordance with plans and
specificatinns on file with the City of Anaheim, mark?d Exhibit hlos. 1 and 2, provided 'now-
~ver, that the sign shall be permitted at its present }~eight and locatior, for a period of
three years only.
