A RESOLUTION OF THE CITY PLANNING COMMISSION OF THE CITY OF ANAHEIM
THAT PETITION FOR VARIANCE N0. 2197 BE DENIED
WHEREAS, the City Plenning Commiasion oE the City of Aneheim did receive e verified Petition for Variance from
JOFW T. AND PHYLLJS J. ALLIIJ, 18e11 Mandarin Lane, Yorba Linda, California 92686, Owners
of certain real property situzted in the City of Anaheim, County of Orange, State of
Califoxnia, described in Exhibit "A" attached hereto and referred to herein as though set
forth in full.
; NHEREAS, the City Planning Commisslon did hold a public headng a2 the City Hell in the City af Anaheim on
~, September 10, 1970, et 2:00 o'clock P.M., notice of said publIc hearing heving been duly given es required by
lew end In eccordaace wlth the provisions of the qneheim Municlpel Code, Chepter 18.68, to hear and consider evidence for
~'. and ageiast said proposed variance and to inveatigete end meke findings and recommendetions in connection therewith;

' WHEREAS, said Commisaion, after due inepection, investtgetion, and study mede by itself and in its behelE,
end efter due conaiderotion of ell evidence and reports offered at seid heering, does find and determine the following
' feots:
1. That the petitioner requeats e verience from the Aneheim Municipel Code. as follo~•s, to sstabiish
an existing apartment as a conforming use on subject p:operty:
a. SECTION 1E.28.050(3) - Minimum reouired dwellinq unit floor area.
(70C square feet required; 330 square feet
proposed}.
b. S ECTION 18.28.050(10-a) - Minimum number of required parkinq spaces.
(la required; 10 proposed).
2. That there are no exceptional or extraordinary circumstances or conditions applicable
to the property involved or to the intended use of the property that do not apply generally
to the property o: class of u=e in the same vi~inity and zone.
3. That the requested variance is not necessary for the preservation and enjoyment of
a substantial property riqht possessed by other property in the same vicinity and zone, and
denied to the property in question.
4. ;~nat approval of subject petition ~vould be granting the petitioner a privilege not
enjoyed by the other property owners in the City of Anaheim.
5. That the petitioner is providing less than 70~; of the required parking for zn aoart-
ment development thereby creating an on-street parking situation whicli is detrimental to
tl~e area.
6. That although tt:e Flanning Commission, by policy, has granted bacFielor apartments
having 425 square feet, ttie existing apartment is 25% less t!ian the minimum allowed under
said policy and approval would be setting an undesirable precedent.
7. Tnat approval of subject petition would encourage further violations of the Anaheim
Niunicipal Code and lead to the weakenzng o:° the zonin9 and building codes, since these
codes were es',;ablished far the protection of the citizens of the City of Anaheim.
B. That two persons appeared, representing 6 persons present in the Council Chamber
all in opposition to subject petition.
