WHEREAS, the City Planning Commission did hold e public ~earing at the City Hall in the City of Aneheim on
September 21, 1970, at 2:00 o'clock P.M, notice of said public heering heving been duly given as required by
law and in accordance with the provisions of the Aneheim Municipal Code, Chepter 18.72, to hear and consider evidence
[or and ageinst said proposed reclessification end to invesicgate and make findings end recommendetions in connection
therewith; end
WHEREAS, said Commission, efter due inspection, investigetion, and study made by itself end in its behelf, and
efter due consideretion of all evidence end reports offered et soid hesring, does Eind and determine the follawing facts:
1. That the petitioner proposes a reclessificetion of the abc~ve described property from the R-A~ QgricUltural
and C-1, Gene*al Commercial, zones to the R-3, Multiple Family Residenitial, Zone.
2. That the proposed reclassification is substantially in conformance with the
Ge~eral Plan.
3. That the proposed reclessificetion of subJect property is necesser~ a~nd/or desireble (or the orderly end pro-
per develapment of the community.
4. Thet the propoaed reclessificetian of subject property does properly relete to the zones and tf~eir pecmitted
uses locelly established in close proximity tu subject property and to the zones aRd theic permitted uses generally estab-
lished throughout the community.
5. That the proposed reclassification of subject property requires the dedication
and improvement uf abutting streets in accordance with the Circulation Element of
the General Plan, due to the anticipated increase in traffic which will be
~enerated by the intensification of land us~.

NOW, THEREFORE, BE IT RESOLVED that the Anaheim City Planning Commission does hereby
recommend to the City Council of the City of Anaheim that subject Petition for Reclassifica-
tion be approved and, by so doing, that Title 18-7_oning of the Anaheim Municipal Code be
amended to exclude the above described property from the R-A, Agricultural and C-1, General
Commercial, Zones and to incorporate said described property into the R-3, Multiple Family
Residential, Zone, on Portion p, and from the R-A, Agricultural, Zone and te incorporate
said described property into the C-1, G2neral Commercial, Zone, on Portion B, upon the
following conditions which are hereby found to be a necessai•y prerequisite ~o the proposed
, use of subject property in order to preserve the safety and general welfare of the Citizens
of the City of Anaheim.
le That the owner(s) of subject property shall deed to the City of Anaheim a strip of land
' 45 feet in width from the centerline of the street rlcng Dale Avenue, for street widening
purposes.
2o That all engineering requirements of the City of Anaheim along Lincoln and Da).e Avenues,
,~.~~ including preparation of improvement plans and installation of all improvements, such as
curbs and gutters, sidewalks, street grading and paving, drainage facilities or other ap-
# ' purtenant work shall be complied with as required Uy the City Engineer and in accordance
,. U~ith standard plans and specifications on file in the office of the City Engineer; that
street lighting facilities along Lincoln and Dale A~~enues shall be installed as required by
the Director of Public Utilities and in accordance with standard plans and specifications
on file in the office of the Director of Public Utilities; and that a bond in an amount and
form satisfactory to the City of Anaheim shall be posted with the City to guarantee the
installation of ~he above mentioned requirements.
' 3. That the owner(s) of subject property 5ha11 pay to the City of Anaheim the sum of 15¢ per
front foot along Lincoln and Dale Avenues, for tree planting purposes.
4. That trash storage areas shall be provided in accordance with approved plans on file with
the office of the Director of Public Works.
5. That fire hydrants shall be installed as required and determined to be necessary by the
Chief of the Fire Department.
Ei, That a 6-foot masonry wall shall be constructed along the east p_operty line adjacent
to R-A zoned pro~erty and bet~r~een Portions A and II.
7. Tha~t all air-conditioning facilities shall be properly shielded from view and the sound
buffered from adjacent properties.
8. :hat a parcel map to record the approved division of subject property be submitted to
i` and approved by the City of Anaheim and then be recorded in the office of the Orange County
i,! Recorder.
9. That subject property shall be served by u~dergound utilities.
; l0o That tlie owner(s) of subject property shall pay to the City of Anaheim the sum of $75 per
~:; multiple-family unit, to be used for park and recreation purposes, said amouni: to be paid at
the time the building permit is issued.
r_ llo Drainage of subject property shall be disposed of in a manner satisfactory to the City
Engineer.
12~ That a 35-foot strip of land shall be landscaped on the Lincoln Avenue frontage, plans
for said landscaping to be approved by the De~~elopment Services Department.
~3. Prior to the introduction of an ordinance rezoning subject property, Condition Nos. 1,
2, and 3, above mentioned, shall be complei:ed. The provisions or rights granted :;y ~.his
resolution shall become null and void by action of tne City Council unles=_ said cor,di.tions
are complied with within one year from the date hereof, or such further time as the Gity
Council may grant.
~ 14. That Condition Nos. 4, 5, 6, 7, 8, 9, 10, 11, and 12 above mentioned, shall be complied
with prior to final building and zoning inspections.
