A RESOLUTION OF THE CITY FLANNING COMMISSION OF THE CITY OF ANAHE?M
THAT PETITION FOR CONDITIONAL USE PERMIT 1208 gE DENIED
WHEREAS, the City Planning Commission of the City of Anaheim did receive e cerified Petition for Con-
ditional Use Yermit from KIMBRELL AND KIMBRELL, INCORPORATED, 6291 Burnham Avenue, Buena
j Park, California 90620, Owner; BALBOA PACIFIC DEVELOPMENT COMPANY, P. 0. Box 4585, Irvine,
California 92664, Agent of certain real property situated in the City of Anaheim, County
of Orange, State of California, described as Lot Nos. 11 through 31 and 52 thru 55 of
Tract No. a643.
; and
WHEREAS, the City Plenning Commission did hald e public hearing et the City Hall in the City of Aneheim
on November 16, 1970, et 2:00 o'clock P.M., notice of said publi~ heering heving been duly given
as required by law and in accordence with the provisions of the Aneheim Municipal code, Chepter 18.64, to hear
and consider evidence for and against said pcoposed conditionel use and to investigate end make findings end
recommendations in connection therewith; and
WHEREAS, said Commission, after due insp2ction, investigation, and study mede oy itself and in its be-
half, and efter due consideration of ell evidence and reports offered et said hearing, does find and determine the
following facts:
1. Thet the proposed use is properly one Eor which e Conditionel Use Permit is authorized by Ordinance
No. 2861 to wit: establish a 95-unit condominium complex with waivers of:
a. ORDINAWCE N0. 2R61 - Minimum number o,` r~quired parkinq spaces.
(240 required; 168 proposed).
b. SECTICN 18.z9.050(6-a-1~ - Minimum required buildinq setback. (20
feet from ultimate right-of-way line re-
quired; 17 feet oroposed).
2. That Ordinance No. 2861 was established as an urgency ordinance approximately
on? month ago wherein a minimum of 2~ parking spaces shall be required within condominium
projects, and ne evidence has been submitted which would justify a waiver of the parking
requirer~ents as estabiished in this recently adopted ordinance.
3. That parking requirements for condominiums should be considered in the same
light as parking requirements for single family homes since both represent home ownership
and it is anticipated that the parking demard for both types of developments will be
similar.
4. That one person representing four persons present in the Council Chamber aopeared
in opposition to the waiver of the required parking.
