WHEREAS, the City Planning Cc~mmiasion did hold a pubfic heering at the City Hell in the City of Aneheim on ' November 30, 1970, et 2:00 o'clock P.M., notice of seid public hearing having been duly given es requlred by , lew end ln eccocdeace with the provislons of the Anaheim Municlpal Code, Chapter 18.68, to hear end coneIder evidence for end egelnst said proposed varience end to investiQate and meke findings end :ecommendetions in connection therewith; and WHEREAS, satd Commisaion, efter due inepection, investigetion, end study mede by itself and in its behel[, end aEter due considerotion of ell evidence and reports offered at seid heering, does find and detecmine the following fecte: 1. Thet the petltioner requests a verience from the Anehetm Municipel Code as follows: a. SECTION 18.24.030(4-a) - Minimum lot area. (7200 syuare feet required; 5355 square feet to 7200 square feet prooosed). b. SECTION 18.04.075 - Code requirement that all lots rear upon an arterial street. (One side-on lot proposed along Ninth Street). 2. That waiver 1-a, above mentioned, is granted in part,.provided the developer revises the tract map by deleting one lot along the westerly property line and incorporating said lot width into the remaining lots abuttina the n-1 properties to the west. 3. That waiver 1-b, above mentioned, is hereby grznteo on the basis that it would be extremely difficult to develop a parcel of this size and shape without having a side-on lot. 4. That the petitioner stipulated to eliminating one lot along the westerly property line. 5. That there are exceptional or extraordinary circumstances or conditions applicable to the property involved or to the intended use of the property that do not apply generali~ to the property or class of use in the same vicinity and zone. 6. That the requested variance is necessary for the preservation and enijoyment of a substantial property+riqht possessed by other property in the same vicinity and zone, and denied to the proper,.y in question. ?. That the requested variance will not be matexially detrimental to the public welfare or injurious to the property or irnprovements in such vicinity and zone in which the property is lucated. 8. That ttiree persons appeared, and a telegram was received, all in opposition to wai~er of the lot width and si.ze. A ;~ ~_ ~ ~~: ',, i in part NOW, THEREFORE, BE IT RESOLVED that the Aneheim City Planning Commission does hereby grant~subject Petitio^ Eor VAriance, upon the following conditions which are hereby found to be a necessary prerequisite to the pro- posed use of the subject property in order to preserve the sefety and general welfere of the Citizens of the City oE Anaheim. 1. That this variance is granted subject to the completion of Reclassification No. 68-69-41. 2.
