WHEREAS, the City Planning Commission of the City of Anaheim did receive a verified Petition for Conditional
Use Permitfrom VIGILANT ENTERPRISES, INCORPORATED, 1178 VJest Katella, Anah9im, California
92802, Ovuner; FRANK A. SMITH, JR., 1190 West Katella, Anaheim, California 92802, Agent of
certain re~l properi:y situated in the City of Anaheim, County of Orange, State of California,
described as Parcel 1: That portion of Lot 1 of Walnut Colony Tract, as shown on a mao filed
in book 1 page 14 of Record of Surveys, in the ofiice of the County Recorder of Orange County.
Beginning at the intersection of the west line of said Lot 1 or its northerly extension and
the center line of Katella Avenue, and running thence South along said west line 280 feet;

WHEREAS, the City Planning Commission did hold a public hearing at the City Hall in the City oE Anaheim on
November 30~ 1970, at 2:00 o'clock P.M., notice of said public hearing having been duly given as required by
law and in accordance with the provisions of the Aneheim Municipel code, Chapter 18.64, to hear end consider evidence
for and agair.st seid proposed conditionel use and to investigate and mnke findings end recommendations in connection
therewith; end
WHEREAS, said Commission, after due inspection, investigetion, and study mede by itself and in its behalC, and
aEter due cansideration o( all evidence end reports offered et said hearing, does Eind end determine the following tects:
1. That the proposed use is properly one tor which a Conditianel Use Permit is authorized by COde;
Section 18.40.060,to wit: establish on-sale beer and wine in conjurction v~ith a proposed
restaurant, with waiver of:

(66 snaces required; 57 soaces provided).
2. That on-sale beer and wine is being conducted in a pizza parlor vdithin this
s}iopping center, and therefcre, this proposal to add a similar use is likely to have
no adverse effect upon the area.
3, That the proposed use will not adversely aftect the edjoining ]and uses and the gcowth and deve:opment of
the erea in which it is proposed to be lacated.
G, That the size and shape of the site proposed for the use is adequete to ellow the full developm ent ofthe
proposed use in e manner not detrimentel to the particular area nor to the peace, health, safety, end general wel[are of
the Citizens of the City oE Anaheim.

NOW, THEREFORE, BE IT RESOLVED that the Anaheim City Planning Commission does hereby grant subject
Petition for Conditionel Use Permit, upon the (ollowing conditions which are hereby faund to be a necessery prerequisite
to the proposed use of the subject property in order to pteserve the sefety and general welfare ofthe Citizens octhe
City of Aneheim:
