A RESOLUTION Or THE CITY PLANNING COMMISSION OF THE CITY OF ANAHLIM
THAT PETITION FOR AMENDMENT OF VARIANCE N0, 800 BE DENIED
, WHEREAS, the City Planning Commission of the City of Anaheim did receive a verified
i? i Petition to delete Condition No. 1 of Variance No. 800 from Resolution No. 173, granted
,;.`r,, by the Planning Commission on February ~, 1958.
;and
WHEREAS, the City Planning Coc~unission did hold a public hearing at the City Hall in
*_he City of Anahei_m on December 14, 1970, at 2:00 o'clock P.M., notice of said public
hearing having been duly given as required by law and in accordance with tt.e provisions of
the P.naheim Municipal Code, Chapter 18.68; L•o hear and consider evidence for and against
said proposed variance and to investigate and make findings and recommendations in conr.ection
therewith; and
WHEREAS, said Commission, after due inspection, investigation, and study made by
itself and in its behalf and after d;~e consi3eration of all evidence and repor:.s offered
at said hearing, does find and determine [ne following facts:
1. That the petitioner requests an amendment to the condition of Variance No. 800
which prohibited vehicuiar access to and from ~dalnut Street from subjecC property.
2. That there are no excep~ionai or extraordinary circumstances or conditions applic.able
to the property involved or to the intended use of the property that do not apply generally
to the property or class of use in the same vicinity and zone.
3. That the requested deletion is not necessary for the preservation and enjoyment
of a substantial property right possessed by other property in the same vicinity and zone
and denied to ti~e property in question.
4. That approval of the request would be materially detrimental to the public welfare
of injurious to the property or improvements in such vicinity and zone in which the property
is located.
5. That three persons appr:ared in opFosition.
6. That petitions with 716 signatures were presented in opposition.
7. That conditions have not changed so as to justify r.elief from a requirement
originally imrosed to protect the puUlic health, safety and general welfare.

NOW, THEREFORE, BE IT RESOLVED that the Anaheim City P]anning Commission does hereby deny subject
Petition for Variance on the basis of the aforementioned findings.
