Section 18.63.040(b} to wits erect a billboard which exceeds the maximum permitted

a residential structure. (27 feet permitted;

of 75 feet required; 70 feet proposed).
c. SECTION 18.63.050(b) - Minimum setback from an arterial street. (10 r'eet
required; 0 feet pr~posed).
2. That the request for permission to construct a billboard exceeding 300 squaie
feet in area, to permit a display area of G74 syuare feet, is herby denied on the basis
that adequate signing on the billboard can be accomplis}ied within Code requirements;
furtheamore, a billboard more than twice the size permitted by Code, would establish an
undesirab~e precedent for similar requests, wnerein other areas of the City would be even
more seriously affected than the area wherein subject property is ~ocated.
3. That Waiver 1-a, above mentioned, is hereby denied on the basis that single family
homes to the north and east are within 130 feet of the site of the proposEd 39z foot hi,gh
billboard, and a billboard of the proposed height ana area could prove to be deleterious to
the residential integrity of that area.
4. That Waiver 1-c, above.mentioned, has been withdrawn by the petitioner, since
revised plans provide fer the required 10-foot structural setback from the ultimate right-
of-~way of Brookhurst Street.
5. That Vlalver 1-b, above mentioned, is hereby granted under the authority of Section
~, 18.64.070, on the basis that the single family residential structure which created the
, necessity of this waiver has been appr.oved for and is presently being used as a child care
nursery, and the owner has indicated he would not oppose a billboard 70 feet from said
structure.

~ welfare of the Citizens of the City of Anaheim.
, NOW, THEREFORE, BE IT RESOLVED that the Anaheim City Planning Commission does hereby
grant subject Petition for Conditional Use Permit, upon the following conditions which
are hereby found to be a necessary pre¢equisite to the proposed use of the subject
prooerty in order to preserve the safety and general weifare of the Citizens of the City
of Anaheim:
1. That adequate clearance of existing electrical lines shall be provided as re-
quired by the Electricai Division, Department of Publir. Utilitiess and the State of
~~ California G~O. 95, prior to :inai building inspection.
2. That subject property shall be developed in accordance with the provisions of
the Billboard Ordinance; provided, ho~r~ever, that said biilboard may be lo:ated 70 f=et
from a residential structure as granted by the above ~n-aiver.
