A RESOLUTION OF THE CITY PLANNING CAMMISSION OF THE CITY Ok= A::AHEIM
. RL-COMMENDING TO THE CITY COUP7CIL OF THE CTTY OF ANAHEIM A1~IENDMENTS
TO 1}IE ANANEIM MUNICIPAL CODE~ TITLE 18, CHAPTER ]8.G4 GENL-RAL
PROVISIONS AND CHAPTER 1b.Oh, DEFINITIONS, THERETO
WHEREAS, the Development Services .pepartment and City Attorney'S office recently
undertook an analysis of animal provisions contained in each of the City of Anaheim's
~' residential zones in an attempt to establish a greater degree of conforinity between
zones; and

! WHEREAS, the Anaheim Planning Commission upon reviewing said analysis set for
public i;?~r.ing on April 20, 1970 consideration of amendments to Title 18 of the
', ~ Ar.a~.;~ir„ AS~:r,icipal Code; and
!NF!ER~P.~, the City Plannin9 Commission did hold a public hearing at ti~e City
Hall in :I.e C.ity of Anaheim on Aori.l 20. 1970 at 2:00 0'clock P.M., notice of said
publi.c '~eari ;~ having been duly given a_ required by law and in accordance with the
provisions of the Anaheim Municipal Code, to hear and consider evidence for and
against said proposed amendments and t~.nvestigate and mahe findings and recommendations
in connection therewith; and
WHEREAS, said Commission, after due insoection, investigation and study made b~
itself and in its behalf, and after due consideration of all evidence and reports
offered at said hearing does find and determine the following facts:
1. That Chapter 8.08 of the Anaheim Municipal Code contains the adop;,ion
of Orange Courty ordinances pertaining to the keeping of dogs and other
domestic animals.

2. That the City of Anaheim contracts with the County of Orange for the
enforcement of Chapter 8.08.
3. That the proposed amendments, if adopted, will complement and clarify
Chapter 8.08 and eliminate any apparent conflicts, wherein it stat.es
that all animals are to be maintained on the property of th~ir owners,
thereby placing the responsibility for loose animals on their owners;
and further provides that the keeping of larger domestic animals is
prohibited automatically in zones whe:e lot sizes are typically less
than an acre.
4. That said amendments establish setbacks from property lines and dwellings,
other than those of the owners in an attempt to eliminate problems
associate~ witti dust, odor, and minor noise to adjoining property
owners, hov;ever, does not infer that the zoning code is a hea)th code
since it does not establish mi.nimum distances between animal pens or
corrals and the residence of the animal owner.
5. That the permissible number of dogs and cats is restated and clarifies
County ordinances adopted under Chapter 8.08, and although the tota]
number of animals permitted in a multiple family development might be
large, most apartment projects are self-regulatory.
6. 'fhat the kaeping of small, harmless animals such ~s turtles and frogs
in a residence , or wild animals, when in conjunction with zoos,
veterinary hospitals, educationa] institu±ions, and other similar
circumstances as provided for in Chapter 8.20 (wild animals) is re-
st~ted for clarificat;ion of the present ordinance.

NOW, THEREFORE, BE IT RESOLVF.D that the Anaheim City Planning CoT,~nission
does hereby adopt and recommend a~9option of amendments to Title 18, Zor~ing of
the Anaheim Municipal Code, Chapters 18.04, General Provisions and i9.G3,
Definitions as described in Exhibit "A" and referred to as though set forth in
full, on the basis af the foregoing findings.

ANAF~IM ~dL'NICIPAL CODE RELATIbIG TO ZONING.
THE CITY COUNCIL OF THE, CITY pF ANAHEIM UOES ORDAIN AS
FOLLOWS:
SECTION 1.

That Title 18, Chapter 18.04, Section 18.040,020, Subsection (6)
of the Anaheim Munioipal Code be, and the same is hereby aa:ended as follows:
SECTION 18.04.020 GENERAL PROVISION~ Use, Genoral
(6) The keeping of animals for domestic, non-commercial use shall
be permitted in residentiel zones subject t~ the provisions of
Chapter 8.08 oi this Code and the following:
! (8) Animals shall be maintained in coops, pens, corrals, stables,
tethered, or by some othe: means of confinement, in accordance
with the following provisions:
. 1• ;Jo porson shall keep, stable, or tether any eouine, bovine,
sheep, swine, goat on a parcel of property of less than
one acre (43,560 square feet).
2• No person shall keep, stable, or tether any equine, bovine,
sheep, swine, goat, poultry, or birds within fifty (50)
feet of any structure used for humen habitation other than
that oP the owner, or within twenty (20) feet of any
property line.
(b) Poultry, rabbits, birds, and rodents shall not exceed twenty-
four (24) animals per aore. The maximum numher of the abcve
animals permitted on an individual lot or parce.l shall be
proportional to the number permitted on one (1) acre, (i.e.,
one-half acre would permit tv,~elve (12) such animals); provided,
however, that roosters and peacocks shall not be permitted in
any residentiel zone.
(~) Equine shall not exoeed Pour (4) adult animals and their
immsture offspring per acra.
(d) Bovine, sheep, goats, and swine shall not exceed a total of
two (2) animals per eare. ,
~e) Domesti;; houseoats shall not exceed three (3) aniuials aver
the age of four months (4) per dwelling unit. A non-commerciel
kennel may be permitted subject to the appi•oval of the Develop-
ment Services Department and the Orange County Poundmaster.
(f) Dogs shall. not exoeed three (3) animals over the age of four
(4) month~ per dwellir.g unit. A non-commercial kennel may
be permitted subject to the epproval of the Development Serv-
ibes Department and the Orango County Poundmaster.
~B) This section shall not prohibit the keeping of animals whicl~
are gentle as found in nature, such as small turtles, non-
dui:gerous birds, small, non-poisonous sna!ces, non-harmful
fish, or small monkeys.
(h) Thi:; section shall not prohibit the keeping of wild animals
when:
1• In conjunction with zoos, miaseums, circuses, exhibits,
or shows;

2. Under treatment in liaensed veterinary hospitals; or,
3. Maintained by bona f'ide educationai institutions for
the purpose of instruction; provided, however, the
provisions of Seotion 8.20 shall apply.
(i) The keeping of animels not specifically mentioned in this
Chapter is prohibited except as provided under paragrephs
(g) and (h) abot•o.
(j) In the ovent of a conflici: between this Chapter and
Chapter 8.08 of this Code, the provisions of this Chepter
shall be superior.

That Title 18, Chapter 18.08 of the Anaheim Municipal Code be, and the
sRme is hereby amendod, b~~•sdd~ng Sections 18.08.243 and 18.Oi3.247, reading as
follows:
"SECTION 18.08.243 COOP.
"A place of confinement, usually in the form of' a cage or small enclosure,
used con,junotion with the keeping of animals.
"SECTION 18.08.247 CORRAL.
"A yard which is enclosed to adequately confine animals."

That Title 18, Chapter 18.08 of the Anatieim Municipal Code be, and the
same is hereby amended, by emending Ssction 18.08.640, reading as follows:
"SECTION 1Ei.08. 640 STABLE ~ PRNATE
A structure or accessory building for the keeping of animals owned by
the owners or ooaupants of the premises which are not kept for remun-
eration, hire, or sele. A stable may or may not include a corral."
SECTION 4
~`he City Clerk shall oertify to the passoge of this ordic:~nce aad shall
cause the same to be printed once within fiftoen (15) days after its adoption,
in the Anaheim Bulletin, a r.ea~spaper af general circulation, printed, published
and circulated in said City, end thirty (30) days fro¢~ and after its final pas~age
shall take effect and be in full furce.
