RESOLUTION N0. pC70-78 A RESOLUTION OF THE CITY PLANNING COMMISSION OF THE CITY OF ANAHEIM THAT PETITION FOR CONDITIONAL USE PERhiTT NO. 1173 Bg GRANTED WHEREAS, the City Planning ComR;ission of the ~ity of Anaheim did receive a veritied Petition for Conditiona! Use Pecmit from LQ~IORE N. KOLBRICH, 2]30 East South Street, Anahe`_m, California 92806, pu,mer of certain real p:operty situatF•;1 in the City of F,naheim, County of O~ange, Si:ate of California, described as the West .165 feet of the North 650 feet of the L-ast half of tne Northwest quarter of the Northwest quarter of Serction 13, Townsnip 4 South, Range 1G 'Nest, S. B. B. 8 M. ; and K'HEREAS, the City P~anning Commission did hold a public hearing at the City Hall in the City oi Anaheim on h'~ay 18, 1970, at 2:00 ddock P.M., notice of said public hearing having been dul law and in accordance with the provisions o( the Anaheim Municipal code, Chapter 18.64, to hear a d consider evid nce for and agair.st said proposed conditional use and to investigate and make findings and recommendations in connection therewith; and WHEREAS, said Commission, aEter due inspection, investigation, and study made b,y itself and in its behalf, end after due consideration of a11 evidence and reperts offered at said hearing, does find and detertnine the following (acts: 1, That the proposed use is properly one for which a Conditional Use Permit is authorized by COde Section 18.64.020(1-c) to ~vit: permit the use of an existing residential ,tructure for daily chapel services and a rectory, together with occas:onal outdoor daytime masses, and future church ronstruction on subject property. 2. Thet the proposed use will not adversely affect the adjoining land uses and the growth and development of the area in which it is proposed to be located. 3. That the size and shape of the site proposed for the use is adequete to ellow the Fcl1 development of the proposed use in a manner not detrimental to the particular area nor to the peace, health, safety, and genera! welf~re of the Citizens oE the City of Anaheim. 4. That the grenting o( the Conditional Use Permit under the conditions imposed, if any, will not be detrimentc.l to the peace, health, safety, and general welfare of the Citizens of the City of Anaheim. 5. That the petitioner stipulated that no Sunday church servic~•~~ would be conducted ir the chapel; that the major use would be for a rer.tory during the ,i,st phase; and tliat outdoor masses would not exceed four (4) per year and would be limited to daylighF, hours only; provided however, thai: if complaints are received following tfie first outdoor mass no further outdoor masses shall be conducted. Cl-G -1. _ ' i NO,N, TIIEREFORE, BE II' RESOLVED that ~the Ana}ieim City Planning Commission does hereby grant subject Petition for Conditional Use Permit, upon the ioliowing conditions which are hereby found to be a necessary prerequisite to the proposed use of the subject property in order to preserve the safety and 9eneral welfare of the Citizens of the City of Anaheim. 1. That the owner of subject property shall deed to the City of Anaheim a strip ~f land 32 feet in width from the cznter:ine of the street along South Street for street widening purposes. 2. That all engineering requirements of the City of Anaheim along South Street, incl.uding preparation of improvement plans and installation of all improvements, such as curbs and gutters, sidewalks, street grading and paving, drainage facilities, or other anpu:tenant work shall be complied with as required by the City Engineer and in accorda~ce with standard plans and speci- fications on file in the office of the City Engineer; and that a bond in an amount and form satisfactory to the City of Anaheim shall be Fosted with the City to guarantee the installation ~ of the above mentioned requirements. 3. That the owner of subject property shall pay to the City of Anaheim the sum of Y~2.00 per front foot along South Street for street lighting pur oses. ~ 4. That the ovaner of sub'ect ~ ,7 property shall pay to the City of Anatieim the sum of 15~ pei• front foot along South Street for tre~ planting purposes. 5. That the existing structure shall be brought up to the minimum standards of the City of Anaheim, including the Uniform Building, Plumbing, L-lectrical, liousing, h1echanical and Fire Codes as adopted by the City of Anaheim. 6. That Condition Nos. 1, ?_, 3, 4, and 5, above mentioned, shall be complied with prior tu the commencernent of the activity authorized under this resolution, or prior to the time that the buildiny permit is issued, or within a period of 180 days from date hereof,vhichever occurs ° first, or such further time a= the Planning Car~mission and/or City Council may grant. 7. That trash storage areas shall be provided in accordance with approved olans on file with the offir.e of the Director af Public VJorks. 8. That fire nydrants shall be installed as required and determined to be necessary by the Chief of the Fire Department. 9. That all air-conditioni;~g facilities shall be properly shielded from view, and the sound buffered from adjacent residences. 10. That any parking area lighting proposed shal'. be down-lighting of a maximum t;ight of 6-~eet, which li~hting shall be di:ected away from the property lines to protect the residenti:,1 integrity of the area. 11. That subject pro~~erty shall be served by underground utilities. 1?_. That drainaye of subject property shall be disposed of in a manner that is sa2isfactorv to the Cit}• Engineer. 13. That Condition Plos. ', 8, 9, 10, 11, and 12, above mentioned, shall bE complied with ~ prior to fina] buildin9 3nd zoning inspections. ~_ 14. That subja_ct property shall be developed substantial;y in accordance with ~.~lans and specifications on file witl~ the City of Anaheim, marked C-xhibit Nos. 1 and 2. 15. Tliat outdoor meetings, limited to daylight hours on~y may be permitted fcur (4) times a year; provided however, ihat if complaints from neighbors 'are received after the first out- door meeting ther~ no future outdoor meetings will b f permitted.
