A RESOLUTION OF THE CITY PLANNING COMMISSION OF TFTE CITY OF ANAHEIM
THAT ^ i~ 1'1'ION FOR VARIANCE N0. 2176 BE DENIED
WHEREAS, thc City Plenning Commiseion of the City of Anaheim did ceceive a vecified Petition for Variance from
RAYMOND DINKLER, 520 North Rio Vista Street, Anaheim, California 92806, Owner; MODULAR
TECENOLOGY, INCORPORATED, 1104 East 17th Street, Santa Ana, California 92701, Agent of
certain real property situated in the City of Anaheim, County of Orange, State of California,
described in Exhibit "A" attached hereto and referred to herein as though set forth in
full.
WHEREAS, the City Plonning Commisaion did hold a public hearia.g at the City Hall in the City of Anaheim on
June 15, 1970, et 2:00 o'clock P.M., notice of seid public hearing heving been duly given es required by
law end in eccoidance with the provisions of the Anaheim Municipal Code, Chapter 18.68, to hear and consider evidence for
end ageinst seid proposed varience end to investigate end meke Einding's end recommendetions in connection therewith;

WHEREAS, seid Commission, efter due inspection, investigation, end study made by itself end in its behalf,
and efter due consideretion of all evidence and reports otfeced at said hearing, does Eind end detecmine the Eollowing
facts:
1. Thet the petitioner requests a varience from the Aneheim Municipal Code a5 fO110W5 ~ to devBlOp SUbj@ct
property into two tracts having 89 R-3 zoned lots:
a. SECTION 18.28.050(6-a-1) - Minimum landscaped setback alonq an arterial
hiqhway. (?_0-foot setback, fully landscaped,
requirEd; 17-foot setback with 7-feet of
landscaping proposed on one lAt).
b. SECTION 18.28.050(6-a-4) - Minimum landscaoed setback alonq a local
st*eet. (15-foot setback fully landscaped
required; 14-feet, 1?_-feet. 9-feet, 8-feet
and 7-feet proposed).
2. That subject petition is denied on the basis that the Planning Commission has
recommended disapproval of the R-3 zoning on the property, therefore the existing zone
would not permit development of the property as proposed.
3. That there are no exceptional or extraordinary circumstances or conditions applicable
to the property involved or to the intended use of the property that do not apply generally
to the property or class of use in the same vicinity and zone.
4. That the requested variance is not necessary for the preservation and enjoyment of a
substantial property right possessed by other property in the same vicinity and zone, and
denied to the property in question.
5. That the requested variance will be materiall.y detrim?ntal to the public welfare or
injurious to the property or improvements in such vicinity and zone in which the property is
located.
6. That one person appeared before the Commission, representing the single family home-
owners directly affected by the proposal, in opposition.
