A RESOLllTION OF THE CITY PLANNING COMMISSION OF THE CITY OF ANAHEIM
THAT PETITION FOR COt7DITI0NAL USE PERMIT Z 182 BE DENIED
WHEREAS, the City Planning Commission of the City of Anaheim did receive a verified Petition (c* Con-
ditional Use Permit Erom ROY AND CFft?2Y5TAL THOA1PSON, 1727 South Nutwood Street, Anaheim, Califernia
92804, Owners of certain real property situated in the City of Anaheim, County of Orange,
St_ate of California, described as Lot No. 6 of Tract No. 2159.
; and
WHEREAS, the City Planning Commission did hold a public hearing at the City Hall in the City of Anaheim
on June 15, 1970, at 2:00 o'~lock P.M., notice of said public heering having been duly given
as required by law and in accordance with the provisions of the Anaheim Municipol code, Chepter 18.64,to hear
and consider evidence (or and against said proposed conditional use and to investigate and make findings and
recommendatians in connection therewith; and
WHEREAS, snid Commission, a(ter due inspection, investigation, and study made by itself end in its be-
half, and a(ter due consideration oE all evidence and reports offered at seid hearing, does find and determine the
followi~g facts:
1. Thnt the proposed use is propedy one for which a Conditional Use Permit is e~~thorized by Code :
SECtion 18.64.0?_0(1-b) to wit: establish a nursery school in a~ existing structure,
with the followi~a waivers:
a. SL-CTION 18.24.030(5) - Minimum required oarkina soaces in a qaraQe.
(2 suaces required; none proposed).
b~ SL-CT1CN 18.62.060(a) - Maximum oermitted siqn disnlay area. (1-square
foot permitted; 14 square feet proposed).
2. That the approval of the proposed nursery in an area surrounded by single
family homes would permit an encroachment of commercial uses into a residential area,
thereby creati.ng "spot zoning" and detracting from the residential environment.
3. That the proposed use would be lacking in the required r.umber of parking spaces,
and the proposal to asphalt the residential setback area would be creating an undesirable
app?arance for this general area.
4. I'hat this parcel, along with the other R-1 parcels on Nutwood Street was consider-
ed in the Front-On Study that was adopted by the Planning Commissicn and City Council in
1967; and that the conclusions reached in that study indicated that these particular lots,
rather than having future commercial potential, should be retained for single-family
residentia: uses.
5. Tha~ the proposed use will adversely affect the adjoining land uses ar~d the
growth and development of the area in whicn it is proposed to be located.
6. Tliat the granting of the Conditional Use Permit wili be detrimental to the peace,
health, safety, and genera] welfare of the Citizens of the City of Ar.aheim.
7. That ar,e person appeared representing four persons present in the Council Chamber,
in opposition, and that two letters and a petition signed by 51 persons was received, also
in opposition.

NOW, THEREFORE, BE IT RESOLVED thet the Anaheim City Plenning Commission does hereby deny subject
Petition for Conditionel Use Permit on the basis of the aforementioned findings.
