WI{i:REAS, the Planning Commission determined that although
Chapter 18.59 (Scenic Corridor ~~verlay, Zone) was recommended as to
concept, additional amendments should be made to tl~e original document
prior to City Council consideration, and these amendr~ents should be
considered at an advertised public hearin~. Said lzearing was origina2ly
scheduled fnr January 25, 1.971, ho~vever, said hearing had to be rescheduled
for February 8, 1911, due to an error i.n publication of the proposed
acnendments as required by ehe Stnte Planning Act; and
WI~IEREAS, the City Planning Commission did hold said public
hearing in the City Hall i.n the City of Anaheim on February 8, 1971,
at Z:00 o clock P.Ti., no[ic:e of said public hearing having been given as
required by law and in a~cordan~e with the provisions of the Andheim Muni-
cipal Code to hear and consider evidence for and against said proposed
amendments to Chapter 18.59, atid to invescigate and make findings and recom-
mendations in connection therewith; ancl
WH~REt~S; said Commission, after due inspection, investigation,
and study made by itself and in its behalf, and after due consideration
of all evidence ar~d reports offered a[ said 1learing, does find and determine
the following:
1. That Subsectior~s18,59,032(3)(b) and 18.59.Q42(4)(b) now reflect
the elim.ination of the i0-foot Landscaped strip along the
freeway ur expressway side of Cl~e 6~foot high wall, tl~ereby
removing opposition by the property o~oners, developers, and
tlie Commission tha[ chis ser.baclc would not be maintained.
Said 10--foot stri.p w~uld now be coithin the wall which would
assure maintenance by the pruperty owner.

2. That Subsectionsla.~9.032(3)(c) and 18.59.042(4)(c) now make
pr vision co allow reduction in the 75--foot setback to SO
feet on freeways and express~aays where the average elevation
ad~aced7' to the right--of-coay line of the building site is at
least six (6) feet above or below the elevations of the tra~~el
1'anes and provides for full scr.eening of the roadway from
vieto uf the residents by the use of walls, earthen berms and
landscaping.
3. That Subsertions 18,59.032(3)(d) and 18.59.042(4)(d) also
makes provision for the reduction of the 50--foot setback
along ma,jor, primary, secondary,hillside primary, an~ hill-
side secondary highways where variations in wall designs are
prov~ded cohich may include decorative materials st~ch as wr.ought
iron, ~vo~d, stone, or .landscaping; provided, however, that
no more than 10% of the required wall length consists of said
vari_at=on and that said vari.ation have a width no greater
than fi~e (5) feet,
4. Tha~ changes were made in Subsectiori ].8.59.052(1)(a) allowing
a reduction in tr~a 100-foo~ setback to 75 feet under certain
condi:ions.

10. That a fee sho~ild be established for landscaping in lieu of
feea for curbe, gutters, and sidewalks, which will be assessed
to property developers along Santa Ana Ganyon Road.
11, That 8 landowners of large parcels appeared in opposition,
and that 3 persons representing many single family homeowners
in the canyon appeared in favor of Che (SC) Zone.
NOG1, THGRGFORE, BE IT RESOLV~D thak the Anaheim City Planning
Commission does hereby adopt, and recommend to the City Council of the
City of Anaheim the adoption of an amendment to Title 18, Zoning of Che
Anaheim Municipal Code by the addition of Chapter 18.59, Scenic Corridor
Overlay (SC) Zone as amended, and as depicted on Exhibit "A" attached hereto
and referred to as though set forth in full, on the basis of the foiegoing
findings,
BE IT FURTHER RESOLVED that the Anaheim City Planning Commissiun
recommends to the City Council of the City of Anaheim amendments to Title
17, Land Development and Resources, C'.iapter 17.06, Grading, Excavations,
and F:ill in Hillside Areas, s~s depicted on Exhibit "B" attached hereto
and xeferred to as though aet forth in full, on the basis of the foregoing
findings,
AND, BE IT FURTHER RESOLVED that the Anaheim City Planning
Commissi.on recommends tr the City Council that a fee be established £or
l.andscaping in lieu of fees for curbs, gurters and sidewalks to be asaessed
to property developers along Santa Ana Canyon Road, as depicted on Exhibit
"E" attached hereto and referred to as though set forth in fiill.
