WHEREAS, the City Planning Commiaelon did hold a public hearing et the City He11 in the City of Anaheim on
,Iune 28, 1971, at 7:3po'clock P.M., notic:e of seid public hearing heving been duly given es required by
lew and in acoordence with the provisions of the Anaheim NfunicipaI Code, Ctiepter 18.68, to hear and considec evidence for
end against aeid proposed variance and to inve,~tigate and make findings and recommendetions in connection therewith;
and
WHEREAS, said Commission, aftee due inspection, investigetion, end study made by itself end in its behalf,
end efter due conaideration of ell evide~ce and reports offeced at said hearing, does Eind end determine the following
facts:
1. Thet the petitioner requesta e veriance from the Aneheim Municipal Code a s fo l Iows :
a. SECTI:ON 18.28.050(5) - Maximum building height within 150 feet of R-A
property, (One storv permitted; two-story proposed).
b, SCCTION 18.28.050(; - Minimum disCence between buildings. (24, 22 and 1~?
feet required and 10 feet proposed),

c. ~ECTT.ON 1$.28.090(10) -_Maximum disCance from a garage to a unit. (No longer
required).
2. That the pe~itioner proposes development of subject property with a 96-unit apertment
cor~plex on one lol•, and a 97-unit apartment complex on Che second lot.
3. That wai.ver 1-a, above mentioned, is }iereby granted on the basis that the Attahpin;
General Plai7 designates the adjoining R-A parcels as being appropriate for medium density
residential development.
4. That waiver 1-b, above mentioned, is hereby granted in part in that the requested
waiver of ehe required distance between the apar~ment unirs and the adjacent carports is
deemed apprupriate since this s~me waiver ha3 been granted many times in the past; Eurthermore,
the petl[ioner withdrew his req~.iest for waiver of distance between apartment buildin~s.
5. 'it~at the petitiuner withdrew request For waiver 1-c, above mentioned, on the basis
tliat the revised plans no longer need this waiver.
6. That there are excepCional or extraordir~ary circumstancesorconditioits applicabie to
tt~e properLy in~:olved or to the inter.ded use of the property, as approved, tiial- 1o not apply
generally to the property or class of use in the same vicinity and zone.
7. That tt~e requested varir~nce, as approved, is necessary for ttie preservation and enjuy-
men~ oE a substantial pronerty right possessed by other property in the same vicinil-y and zone,
and denied to [he propert}~ in quest.ion.
3. 1'hat khe requested variance, as approved, will not be materially detri.men~aZ to t.he
public welf.are or Lnjurious to the properey or improvements in such vicinity and zone in which
the property is located.
