WHEREAS, said Commission, aftee due inspection, fnveatigetion, and atudy made by itaelf and in its behalf,
end after due consideration of e11 evidence ond ceporta offered at said hearing, does find and determine the following
fects:
1. Thet the petitioner requeste a vadance from the Aneheim Municipal Code• as follows:
a. SECTION 18.28v050(5-b) - hlaximum buildina heiaht within ~50 feet of R-1 »ned
prop~rtv. (One-storv permitted; two-storv proposed)
b. SEC?I~Ji~ 18.28,050~2) - Buildinq site area per dwellinq unit, (1815 spuare
feet proposed; 240C~ square feet required).
c. SECTION 1~.28~050(10) - Min~rr.um reguired parkinq. (5 soac~s required; 4
s aces proposed).
2, The petition,~x proposes to add a third unit over the existing garages.
3. That the size uf the parcel is too small to accommodate an additional dwelling unit
and sti11 meet the parkiny requirements of the R-2 Zone, and if approved, would be over-
building the property~
4~ That the petitioner is proposing a density comparable to that pe~mitted i~~ the R-3
Zone, whereas existing zoning is R-2, which perrnits the existing duplex structure~
5~ That waiver of the parkirig requirement would impose an undue hardship on th? adjoining
prop erties since no parking is permitted on iiaruor Boulevard, and alley parking might be
experienced.
6. That approval of this request would be granting the applicant privileges not enjoyed
by o ther property owners i,n the same zone and i.n this general area.
7~ That there are no exceptional or extraordinary circumstances or conditions applicable
~to t h e property involved or to the intended use of the property that do not apply g~nera:ily
t~ tlze property or class of use ~n the same vicinity and z~ne.
8. That the re~uested variance is not necessary for the presarvation and enjoyment of a
subs tantial property right ~,~ssessed by other property in the same vicinity and zone, and
denied to the property in question.
9. That the requested variance will be materially detrimental to the public welfare or
inju rious to the property or improvements in such vicinity and zonP in which the pror~erty
is located.
