law end in accordance with the provisions of the Anaheim Municipal Code, Chapter 18.~2, to hear end cooslder evidence

NOW~ THEREFORC~ BE I.T RESOLVED that the Anah~im Citv Planning Commission does ~ereby
recommend to the City Council oF the City of Anaheim that subJ'ect Petition for
Reclassific~tion be approv~d and~ by so doin~, that T~{le 18-Zonin~ of the Anaheim
Municipel Code be amended to exclude the above described property from tha C-1~
Ganoral Commercial, Zone and to incorpor•~te said described property into the R-3,
Multiple Family Reaidential~ Zone upon the followin~ conditians which are hereby
found to be a necessary prerequisite to thQ oroposed use of subject property in order
ta ^reserve the safety anc' ~eneral welfare of ±he C~+.izens of the City of Anaheima
(1) Thet the owner(s) of subject property shall deed to +,he Citv of F,,,aheim the
nnrtherly ,5~+ feet of th~ ~outherly 55 feet of subject property f~r new street and
public utility purpose:•~
~2) That all on$ineering requirements of the City of Anaheim alon~ Beach Bo~levard,
Oranqe Avenue~ and the new street~ includin~ preparation of improvement plans and
installation of all improvements~ such as curbs and gutter•s, sidewalks~ street
gradi~~ and paving~ draina~e facilities~ or other appurtenant work shall be camplied
with as required by the City Engineer and in accordance w;th standard plans and
specifications on file in the ufficp of the City Engineer; that street l{ghting
facilities along Beach Boulevard Orange Av9nue, and the new stre~t shall be installed
as required by the Directnr of ~ublic Utilities and in accordance with standard
p.lans and specifications on file in the office oP the Director of Pubi~ Utilities;
and that a bond in an amoun~ and form sa~isfactory to the City of Anaheim shall. be
posted with the C;tv to guarantee the installation of the above mentioned require-
msn~s,
(3) That the owner~s~ of subject pr~perty shall pay to the City of Anaheim the sum
of 15¢ per frant foot along Be.~ch Boulevard, Orange Avenue, and the new street for
tree Flanting purposeso
~4) That trash stara~e areas sha;l be provided in accordance with approved plan~ on
file with the office of the Director of P~.,I~lic Works.
~5) Tha4 fir~ 'iydrants shall be installed as reM~~ired and determined to be necessary
by the Chief of the Fire Departmento
(6) That subject property shall be served by under~round utilities.
(7) That the ~wnar(s) of subject property shall pay to the City of Anaheim the
appropriatc park and recreation in~lieu fees as determined to be appropriate by the
~ity Coun~il~ said fees to be pai~ t the time the building permit is issuedo
($j Th,t drainage of sub'ect pr,~~erty shall be disposed of in a ma rnier that is
satisfaciory to the Ci{y ~ngineer~
~9) That a predetermined price for the southerly one foot of subjECt property shall
be calculated and an irrevocable offer of dedication of said so~therly one foot for
street widening purposes shall be made by the developer and s~~bmitted to and approved
by the City af Anaheim. The cost of said one-foot strip shall include land ~nd a
proportionate share of the utilities and the street improvement costsa
(10) That a 6-foot masonry wall shall be constructed along the west Nroperty line.
(11) That all air-conditiuning facilities shall be properly shielded from view.
(12) That subject property shall be developed s~bstantially in accordance ~ith
plans and specifications on file with the City of Anaheim marked Exhibits Noso 1, 2~
3~ ~~ 5, 6~ ?~ 8, 9~ 10~ and 11~ provided howevera ~'t~at the owner~s) of subject
property shall install a landscaped screen which shall consist of trees planted on
20 foot centers P~o~a ~h~ entfre westerly boundary ~F subject property,
~13) Prior to the introduction of an ordinance rezonin~ subject property, Condition
Nos, 1, 2~ ~, and 9~ above mentioned~ shall be completed, The provisions or rights
granted by this resolution shall become null and void by action of the C{{y Council
unless said conditions are compli~d with within 180 d~ys from the date hereof or
such further time as tr~e Ci{y Council may granto
(1~) That Condition Nos, ~~ 5~ 6~ 8, 10~ 11~ and 12 above mentioned~ shall be
complied with prior to final building and zoning inspections,
