~~~ WHEREAS, said Commission, after due inspecHon, investigation, end study ~nede by itself and in its behelf,

1. Thet the petitioaer requests a variance from the Anaheim Municipal Code as follows:
SECTIUN 18.28.050(6-b-1) -:~Sinimum required distanc~ between buildings. (28
feet required, 8 feet proposed; 15 feet required,
teet proposed; 17 f.eet required, 10 feet proposed).
2. That the petitioner proposes a 90-unit two story apartment complex.
3. That the Planning Commission has recommended disapproval of the underlying zoning
which was requested concurrently with thia petition, and therefare, Chis petition is no louger
appropriate in view o£ that denial.
4. That there are no exceptional or extraordinsry circumstances or conditions applicable
to the property involved or to the intended use of the property that do r.ot apply generally to
the pr.operty or class of use in the same vicinity and zone. „
5. That the requESted variance is not necessary for the preservation and enjoymenr of a
substantiaY property right poasessed by other property in the same vicinity and zone, and
denied to the property in question.
6. That the requested variance will be materially detrimental to the public welfare or
injurtaus to the property or improvements in such vicinity and zone in which the property i~
located,
