RECOMMENDING T~ TyE CITY COUNCIT, OF THE CITY OF ANAHEIM THAT

WHEREAS, the City Planning Commission oE thc Cit~ of Aneheim did recelve e vedfied Petition for Reclessifiea-
tionfrom DOMINICK and NELLIE N. FRENO, 426 South Beach Boulevard, Anaheim, California 92804,
Owners of certain real property siLUated in the City of Aneheim, County of Oraege, State of
California, described as The North 66 feet of the South 528 feet of the West 330 feet of
the Southwest quarter of the Southweat quarter of the Northwest qusrter of Section 13, in
Township 4 South, Range 11 West, in the Rancho Loa Coyotes, a§'ehm,in on'a'map-thereof re-
corded in book 51, page 11, Miacellaneous Mepa, recorde of eaid Orange County. EXCEPT the
Westerly 92.00 feet L•hereof

WHEREAS, the City Planning Commission did hold a public headng at the City Hell in the City of Aneheim on
May 31, 1972, at 2:00 o'clock P.M. notice of seid public hearing heving been duly given es required by
law and in eccordance with the provisions of the Anehe3m Municipnl Code, Chapter 18.72, to hear end consider evidence
for end agelnst seid proposed reclesslficetion end to investigete end meke findings end recommmdetions in connection
therewith; and
WHEREAS, seid Commission, efter due Inspect3on, investigetion, end study mede by itself end In its behalf, and
efter due considerntion of ell evidence end reports ofEered et seid hearin~, does find end determine the following facts:
1. Thet the petitioner proposes a reclessificetion of the ebove described property from the R-A, AGRICULTURAL,
ZONE to the C-1, GENERAL COMMERCIAL, ZONE.
2. That the proposed reclaesification is in conformance with the land use designation
of the General Plan.
3. Thet the proposed reclessificetlon of eubject property ls necessary end/or deslreble (or the orderly and pra
per development oE the community.
4. Thet the proposed reclesstficmtion of subject property does propecly relete to the zones end their permitted
ur.es locelly esteblished in close proxlmity to subJect property end to the zones end thelr permitted uces gene~ally estab-
lished throughout the communlty.
5. That the propesed reclassification of subject property requires the dedication and
improvement of abutting atreeta in accordance with the Circulation Element of the General
P~an due to the anticipated incrrase in traffic, which will be generated by the inteneiEi-
cation of land use.

NOW, THERF.FORE, BE IT~OLVED that thc Anaheim C1ty Plannl~mmissloa does henby recommend .~
to the City Council of the City o Anaheim that subject Petition foc Reclaea ca{ioa be epproved and, by ao doing,
thet TiUe 1&Zoning of the Anaheim Municlpel Code be amended to exelude the above described pmpecty from the
.R-A, AGRICULTURAL, ZONE and to incorporate said described property into the C-1, GENS'RAL
COMMLRCIAL, ZONE upon the following conditione which are hereby found to be a necessary pre-
requisite to the proposed uae of subject property in order to preserve the safety and general
w~elfare of the Citizens of the City of Anaheim:
(1) That the owners of subject property ehall pay to the City of Anaheim the sum of
$2.00 per front fnot along Beach Boulevard for atreet lighting purposes.
(2) That the owners of subject property ahall pay to the City of Anaheim the sum of
15 cents pQr front foot along Beach Boulevard for tree planting pu;-poaes.
(3) That trash storage areas ahall be provided in accordance with approved plans on
file with the office of the Director of Public Worke.
(4) That fire hydrants shall be installed as required and determined to be neceseary
by the Chief of the Fire Department.
(5) That a 6-foot masonry wall shall be constructed along the eaet property line,
(6) That all air conditioning facilities ehall be properly shielded from view, ac~d
the aound buffered from adjacent properties,
(7) That a final parking plan shall be approved by the Development Services Department
and any landscaped areas in the parking area shall be protecCed with 6-inch high concrete
curbs and concrete wheel stopa shall be provided for parking spaces ae required by the Devel-
opment ,3ervices Department.
(8) Prior to the introduction of an ordinance rezoning subjeat property, Condition
Nos. 1 and 2, above mentioned, shall be completed. The proviaione or righta granted by this
resolution shall become null and void by acCion of the City Council unlese said conditiona
are complied with within 180 days from the date her~of or euch further time as the City
~ouncil u~ay grant.
(9) That Condition Nos. 3, 4, 5, 6 and 7, above mentioned, shall be complied with
prior t~ final building and zoning inapectione.
