THAT PETiTION FOR CONDITIONAL USE PERMIT 1315 gE DENIED
WNEREAS, the City Pianning Commission of the City of Anaheim did receive a verified Petition for Con-
ditional Use Permit Erom THE WICKES CORPOFATION, Attenti~n of itoger K, Hall, Vice Pr2sident,
515 North Washington Avenue, Ssginaw, Michigan 48607, Owner; DON KOLL COMPANY, 1901
Dove Street, Newport Seach, California 92660, Agent of certain real property situated
in the City of Anaheim, County of Orange, State cE California, ae describe3 in Exhibit
"A" attached hereto and referred to hercin as though set forth in full
; and
WHEREAS, the CityPlanning Commission did hold a publ?c heating et trie CityHall in the City of Anaheim
on June 12, 1972, at 2:00 o'clock P.M., no!ice of said public hearing heving been duly given
s, required by law aad in accocdence with the provisions oEthe Anaheim Municipel code, Chepter 18.64,to hear
and consider evidence for and egain~t said proposed ccaditio~el use and to invastigate and make findings end
recommendations in connection therewith; aad
u'HEREAS, :.:id Commission, af.ter due insoection, investigation, and study made by itself and in its be-
half, and a{ter due consideration of all evidence and reports offered at seid heacing, does find and determine the
following facts:
1. Thet the proposed use is properly one fo: which a Conditional Use Pet:iit is authorized 6y Code
Section 18.52.050(4) to wit: establish a light stn_c,dard in excess of 100 fePt
ia height.
2. ThaC the proposed structure is considered to Ue a sign rather than simply a
light standard because the Planning Commission determined that when an ancillary
faci.lity, si.ch as the prc,poseu "light standard", is iatended to be aA prominent• as
the applicants havc. indicated it will be aad as the Commiasion expects it to be,
then it is undoubtedly ~ntended to be used for the purpose of. ettra~ting attention.
3. That subjecC property alreac~y hss adequaie signing and approval of the pro-
posed "].ight standard" would be granting addiCional identification not enjoyed by
other businesses throughout the CiCy.
4. That the proposed use will adversely affect the adjoining land uses and the
grow':h and development of the area in which it is proposed to be located.
5. That the peCitioner has not demonstrated that aporoval of the reguested use
was necessary to enjoy a subatantial praperty right enjoyed by ~~hers in the area,
and denied to the petitioner,
6. That lightir.g of the aubject property can be accomplished adequately without
the need to wai•~~ the site developmenr. standards of the M-1 Zone,
7. That gr~nting thts proposal would permit the estnblishment of a use that would
be inconsiatent uith the developmenr standards of the surrounding industrial uses.
8, That the granting of this petition would be set~ing an undea.ireble precedent
for similar requests for other commercial uses chrough~at the Gi!:y,
9, That one person appeared :epresenting cwo induscrial conca•rns adjacent to
3ubject property, both in opposition to the propusEd use.
