A RESOLUTION OF TFIE CITY PLANNING COMMISSION OF THE CITY ~F ANAHEIM
THAT PETITIOIr' FOR CONDITIONAL USE PERMIT ~~~~ BE ~I`~1AITED
1VHEREAS, the City Planning Commission of the City of Anaheim did receive a verified Petition for Con-
ditional Usc Permit from GLADYS 1, BOREN, 1$38 Mountain View, :~nalieim, California 92502, and
WIT.LIAM T, and ETHELYN W. SAMWAYS, 11491 Plantero Drive, Santa Ana, Califorzia 92705,
Owners; SUBURRAN DEVELOPMENT COMPANY, 3i23-~ East Chapmen Avenuz, Orange, California
92669, Agent of certain real property situated in the City of Anaheim, County of Orange,
State of California, as described in Exhibit "A" attached hereto and referred to herein
as though sel- forth in full

WHEREAS, the City Planning Commission did hold a public hearing at the City Hall in the City of Aneheim
on June 12, 1972, at 2:00 o'clock P.M., notice of said public hearing heving been duly given
us required by law and in accordance with the provisions of the Anaheim Municipel code, Chapter 18.64, to hear
and consider evidence for and egainst said proposed conditional use and to investigate and make findings and
recommendations in connection therewith; and
WHEREAS, said Commission, after due inspection, investigetion, end study made by itselE end in its be-
half, end efter due consideration oE all evidence and reports offered et seid hearing, does find end determine the
folluwing facts:
1. That the proposed use is properly one for which a Conditional Use Permit is authorized by Code Section
18.40.060(L) to wie: establish an 81-unit motel with waivers of:
a. SECTION 18,40.070(2-a-2) - Minimum 6uilding setback or. a local street
across from sinRle-family. (10 feet required;
6 feet proposed)
b. SGCT701~ 18.40.070(2-a-S-aZ - Minimum buildin~ setback fro m an ir.terior
property line. (10 feet required; 1 foo~

2. That Waivers 1-a, 1-b, 1-c and 1-d, above mentioned, are hereby gran~ed on tlie
I~asis that the size and shape o£ the parcel makea it di[ficulC to comply wirli the site
development stande:ds, and that adjoining properties are pro,jected f:or commercial uses,
wliicl~ would thue negate tlie need for these waivers.
3. That the proposed use will uot adversely affect the adjoinir.g land uees and tlie
growth and development of the area in wliich it is proposed to be located.
4. That tlie size and shaFe of the site proposed for Lhe use is adequate to allow the
full developmeut of the proposed use in a manner not detrimental to the particular area
nor to tfie peace, health, saEet~, and general wel£are of lhe Citizens o£ the City of
Anaheim.
5. Tt~at the granting of the Conditional Use Permit under the conditions imposed, if
any, wili not be detrimental to ttie peace, healtti, safety, and general welfare ef the
Citizens of the City of Analieim.

cent to existing commercial uses.
7. That one person appeared expressing concern regarding the location of the swim-
ming pool and requesting tl~at the proposed swimming pool be relocated away from the mol;ile

. NOW, THEREFORE, BE IT RESOLVED that the Aneheim City Plenning Commission does hercby grent subject
Petition for Conditionel Use Permit, up~n the following conditions whicF. ere hereby Eound to be a necessary pcerequisite
to the proposed use of the subject property in order to preserve the sefety end general wel[~re oEthe Citizens oEthe
City of Aneheim:
(1) That this Conditional Use Permit is granted subject to the completion uf Reciassi-
fication No. 71-72-52, now pending.
(2) That subject property shall be developed aubstantially in conformance wi[h plans
and specifications on file with the City of Anaheim marked Exhibit Nos. 1 and 2 provided,
however, that the pool shall be relocated to the. north as stipulated to by the petitioner.
