A RESOLUTION OF THE CITY PLANNING COMMISSION OF THE CITY OF ANAHEIM
THAT PETITION FOR VARIANCE NO. 2315 BE GRANTED
It'HEREAS, the City Planning Commission of the City of Anaheim did xeceive e verified Petition for Varience
from ELWA~D F ROSS, 924 North Euclid Street, Anaheim, California 92801, Owner
of certain real property situated in the City of Anaheim, County of Orange,
State of California described as Lot No. 17 of Tract No. 2161
; and
WHEREAS, the City Plenning Commission did hoi~ a public heering et the City Hall in the City oE Anaheim
on February 7, 1972, at 2:00 o'clock P.M., notice of said public heacinghavingbeen duly given es required
by law and in nccocdance with the ~rovisions of the Anaheim Municipe! Code, Chapter 18.68,to hear snd consider
evidence Eor and against se;~i proposed variance end to investigate end make findings and recommendations in connec-
tion therewith; end
WHEREAS, said Commissinn, after due inspection, investigatlon, and study mede by Itself and in its behelf,
and aEter due consideration of all evidence and ceports offered et said heacing, does find and detennine the following
fects
1. Thet the petitioner reauests a variance fcom the Anaheim Municipel Code:
(a) SECTION 18.40.050(a) - Req~irement that all par!<ing be provided Co
the rear of the r.esidential structure. (The
applicant proposes to provide parking in the
front setback)
(b) SECTION 16.40.070(4-a-1-c) - Minim~im number of: required parking
stalls. (9 roquired;.4 proposed)
2. Thet there ere exceptional or extreordinery circumstenc~s or conditions appliceble to the property involved
or to t`~e intended use of the property that do not apply generally to the property or cless of use in the seme vicinity
end zone.
3. Thut the :e.quested varience is necessary for the preservcrtion and enjoymertt of e suostentiel property right
possessed by other propert;,~ in the seme vicinity and zone, end denied to the propEdy i.n question.
4. That the requested variance will not be meteriollp detrimentel to the public welfare or injurious to the prop-
erty or impcovertients in such vicinity and zone in which the property is loceted.
5. That the petitioner stipulated that only one pY.ysician would be using
the buildin3.

N~W, TI?EREFORE, BE IT RESOLVED that the Anaheim City Planning Commission
does hereby grant subjact Petition for Variance, upon the following ~onditions
which are hereby found to be a necessary prerequisite to the proposed ttse of
the subject prcperty ir. order to preserve the safety and general welfare of
the Citizens of the City of Anaheim:
1. That trash storage areas shall be provideci in accordance with apNroved
plans on file with the office of the Director of Public Works.
2. That any parking area iighting proposed shall be down-lighting of a
maximum height of 6 feet, which lighting shall be directed away from the
property lines to protect the residential integrity of the area.
3. That the existing structure shall be brought up to the minimum
standards of the City of Anaheim, ir.cluding the Uniform Buildi.ng, Plumbing,
Electrical, Hou~ing, Mechar.ical and Fire Codes as adopted by the City of .
Anaheim.
4. That the final parking plan shall be approved by the Development
Services Department, and any landscaped areas in the parking area shall be
protected with 6-inch high, concrete curbs, and concrEte wheel stops shall be
provided for parking spaces as required by the Develorment Services Department.
5. That Condition Nos. l, 2, 3, and 4, above mentioned, shall be complied
with prior to the commencement of the activity authorized under this resolution,
or prior to the time that the building permit is issued, or within a period of
180 days from date h=reof, whichever occurs first, or such further time as the
Flaiining Commission may grant.
6~ That subject property shall bp developed substantially in accordance
with plans anc? soecifications on file with the City of Anaheim marked Exhibit
Nos. 1, 2, 3, 4(Revision No. 1), and 5.
7. That this variance petition is granted for a period of three (3) years,
and aC the expiration of this time period and upon written request by the
applicant, the Planning Commission will review the matter for consideration of
an additional period of time.
8. That only one physician shall be permitted to occupy the facility as
stipulated to by the petitioner.
