A RESOLUTION OF THE CITY PLANNING COMMISSIUN OF THE CITY OF ANAHEIM
THAT PETITION FOR VARIANCE NO. 2402 BE GRANTED
WHEREAS, the City Planning Commission of the City of Anaheim did teceive a verified Petition for Varience
from RAYMOND MASCIEL, 1127 West North Street, Anaheim, California 92801, Owner of certain
real property situated in the Citq of Anaheim, County of Orange, State of California, des-
cribed as Lot No. 29 of Tract No, 247
; and
WHEREAS, the City Planning Commissiun did hold a public heering at the City Hall in the City of Anaheim
on July 24, 1972, Rt 2:00 o'clock P.M., notice uf seid public heacing having 6een duly given as requiced
by law and in accordance with the provisions of the Anaheim Municipel Code, Chepter 18.68,to heerand consider
evidence for and ageinst seid praposed variance end to investigate and meke findings end recommendations in connec-
tion therewith; and
WHEREAS, safid Commission, efter due inspection, investigatlon, and study mede by itself and in its behelf,
and aE!er due consideration of all evidence and reports offered at seid hearing, does find and deteimine the following
facts:
1. That the petitioner reauests variances. fiom the Anaheim Municipal Code as follows:
(a) SECTION 18.28.050(6-a-5) - Vehicular access to Rarages from the alley only.
(is required; access proposed from Sabina Street)
(b) SEC'PION 18.28.050(10-a) - Minimum cff-street parking. (2 covered and 2 open
required; 2 covered and 1 open propoaed)
(c) SECTION 18.28.050(6-b) - Minimum building setback. (8 feet requirecY; 6_5
feet proposed)
2. Ttiat Waiver 1-a is granted on the basis that the location of the existing residential
structure precludes the provision ef vehicular access to tl2e proposed garage.
3, That Waiver 1-b is graated on the basis tnat the existing residence has no off-street
parking provisions.
4. That Waiver 1-c is granted on the basis that the exisling residence ia located closer
than 8 feet as required by code.
5. That there are exceptionat or extraocdinery circumstences or conditions eppliceble to the ptoperty involved
or to the intended use of the property that do not apply gene:ally to the propecty or class of use in the same vicinity
and zone.
6, That the requested variance is necessary for the preservation and enjoyment of a subsQantial prupecty right
possessed by other property in the same vicinity and zone, end denied to the ptoperty in question:
7. That !!;e requested variance will not be maYerially detrimental to the public welfare or ir.jurr.ous to the pmp-
etiy or impcoven~ents in sucn vicinity and zone in which the property is loceted.

NOW, THEREFORE, BE IT RESOLVEp that the Anehe3m City Plenning Commission does heceby grant subject
Petition for Variance, upon the following conditions which ere heceby faund to he a necessary precequisite to the pro-
posed use of the subject property in order to preserve the snfety and general welface of the Citizens of the City of
Anaheim:
(1) That the owner(s) of subject property shall deed to the City of Anaheim a strip of
land ten feet in width from the ~enterline of the street along the alley for ctreet widening
purposes.
(2) That the existing atructure shall be brought np to the minimum standarda o£ the
City of Anaheim, including the Uniform Building~ Plumbing, ELectrical, Houaing, Mechanical and
Fire Codes as adopted by the City of Anaheim.
(3) That the owner(s) of subject property shall pay to the City of Anaheim the appro-
priate park and recreation in-lieu fees as determined to be sppropriate by the City Council,
said fees to be paid at the time t`~e building permit is isaued.
(4) That subject property shall be developed eubstantially In accordance with plane
and specifications on file with the Ci.ty of Anaheim marked Exhibits 1, 2 und 3.
(5) That Condition No. I, above mentioned, shall be complied with prior to the co~nence-
ment of the activity authorized under this resolution or prior tu the time that the building
permit is isaued or within e period af 180 days from date hereof, whichever occurs first, or
such further ~ime as the Planning Cammiesion may grent.
(6) That Condition Nos. 2 and 4, ubove mentioned, ahall be complied with prior to final
building and zoning inspections.
