A RESOLUTION UF THE C1TY PLANNING COMMISSION OF THE CITY OF ANAHEIM
RECOMMENDING TO THE C1TY COUNCIL OF THE CITY OF ANAHEIM THAT
PETITION FOR RECLASSIFICATION NO. ~~-73'?~ BE APPROVED
WHEREAS, the City Planning Commission of the City of Anaheim did receive a verified Petition for Reclassifice-
tionfrom KEITH NOSACK, 1830 South West Street, Anaheim, California 92802; W. L. HOHENSEE,
522 Weat Vermont Avenue, Anaheim, California 92805, Ovmers; RAY CHERMAK, Sandman Motels,
Incorporated, 2082 Business Center Drive, Suite 223, Irvine, California 92664, Agent of
certain real property situated in the City of Anaheim, County of Orange, State of California,
as described in Exhibit "A" attached hereto and referred to herein ae though aet forth in
full
; end
WHEREAS, fhe City Plenning Coma~issiort did hold a pubiic hearing et the City Hall in the City of Aneheim on
August 21, 7.972, at~2:00 o'clock P.M. notice of seid putlic heaeing heving been duly given es required by
lew end In accordance with the provisions of the Aneheim Municipel Code, Chapter 18.72, to hear end consider evldence
fo: end against seid proposed reclassificetion end to inves:igate end make findings and recommendetiona in connectlon
therewith; and
WHEREAS, seid Commission, efter due inspection, investigetion, and study mede by itself end in its behelf, and
efter due wnsideretion oE e!1 evidence end reanrts offered et seid hearing, does find end determine the following fects:
1. That the petitioner proposes e r~clessificetion of the ebove described property from the R-A, AGRICULTURAL,
ZONE, to the C-R, COMMERCIAL k~CREATION, ZONE,
2. That the prc+posed reclassificatic.n i3 in conformance with tho land uge deaignation
of the General Plan.
3. That the propoaed reclassification ia con~istent with exiating land uses in the
vicinity of the request,
4. Thet the proposed ceclessificetion of subject property is necessery and/or desireble foc the orderly end pro-
per development of the community.
5. Thet the proposed ceclesslficetion o: subject property does properly celete to 6he zones and their permitted
u~es locelly established in close proxlmity to subject property end to the ~ones and their permitted uses generelly esteb-
Ilahed throughout the community.
6. That the proposed 1•eclassification of subject properCy requirea the dedication and
imFrovement of.abutting streets in accordance with the Circuiation Element of the Genersl
Plan due to the anticipated increase in traffic which will be generated by the intensifica-

NOTd, THEREFORE, BE IT RE~VED rhat the Ansheim City Plen~g Commission does hereby rec-
ommend to the City Council of the City of Anaheim that subject Petition for Reclasaification be
approved and, by so duing, thar_ Title 18-Zoning of the Anaheim ~unicipal Code be amended to ex-
cltlde the above described property from the~R-A, AGRICULTURAL, ZONE and to i.ncorporate said
deacribed property into the C-R, COMMERCIAL RECREe1TI0N, ZONE, upon the f~llowing conditione
which are hereby found to be a neceseary prerequisite to the proposed use of aubject property
in order to preserve the safety and general weifare of the Citizena of the City of Anahzim:
(1) That the owners of suSject property shall deed to the City of Anaheim a atrip of land
53 feet in width fram the centerline of the street along Harbor Boulevard for street widening
purposes.
(2) That all engineering requirements of the City of Anaheim along Harbor Boulevard, in-
cluding preparation of improvement pfans and installation of all improvements, such ae curbs
and gutters, sidewalka, street grading and pavin~, drainage facilities or other appurtenant
~work shall be complied with ae required by the City Engineer and in accordance with etandard
plana and apecificatiuns on f.ile in the office of the ~ity Engineer; that street lighting faci-
lities along Harbor Boulevard ahall be inatalled as required by the Director of Public Utili-
ties and in accurdanc@ with atandard plans and apecifications on file in the offiee of the
Director of Public Utilities; and that a bond in an amount and form satiafactory to the City of
Anaheim shall be posted with the City to guarantee the installation of the above mentioned
requirementa,
(3) That the owners of eub~ect property shall pay to the City of Anaheim tte sum of 15
centa per front foot along Harbor Boulevard for tree planting purposes.
(4) That trash atorage areas shall be provided in accordance with epproved plans on
file with the office of the Director of Public Worka.
(5) 'Lhat fire hydrants shall be inatalled as required and determined to be neceasary by
the Chief of the Fire Department.
(6) That all air conditioning facilities ahall be properly ahielded from view and the
sound buffered from adjacent properties.
(7) That a parcel mep to record the approved diviaion of subject property be suhmitted to
and approved by the City of Anaheim and then be recorded in the office of the Orange County
Reccrder prior to the isauance of a building permit.
(S) That subject property shall be aerved by underground utilities.
(9), That subject praperty shall be deve2oped subatsntially in conformance with p1Ane and
specifications on file with the City of Anaheim marked Exhibit Nos. 1, 2 snd 3.
(IlO) That ordinances reclassifying the property shall be adbpted as each parcel is ready
ta comply with conditione pertaining to auch pArcel provided, however, that the word "parcel"
sh~ll mean presently existing pprcels of record and any parcel or parcele approved by the City
Council for a lot split.
(Z1) That drainage of subjece property shall be diaposed of in a manner that ia~ satiefac-
tory to the City Engineer.
(12) Frior to the introduction of an ordinance rezoning aubject property, Condition Nos.
1, 2 and 3, above mentioned, shall be completed. The proviaiona or rights granted by this
resolution shall become null and void by action of the City Council unless said conditions
are complied with within one year from the date hereof or cuch further time ae the rity Council
may grant.
(13) That Condition Nos. 4, 5, 6, S, 9 and 11, above mentioned, ehall be complied kith
prior to final builling and zoning inspections.
