A RESOLUTION OF THE CITY PLAN'~ING COMMISSION OF THE CITY OF
ANAHEIM RECOMMENDING TO THE CITY COUNCIL OF THE CITY OF ANAHEIM
THE ESTABLISHMENT OF A ZONING ELEMENT IN CONNECTION WIiH
GENERAL PLAN AMENDMENT N0. 123-A THERETO
WHEREAS, the City Council of the City of Anaheim did adopt a General
Plan by Resolution 69R-644 showing the general description and extent of
land uses within the City and indicating the present belief of the Council
as to possible future development and redevelopment of land within the
City; and
WHEREAS, the City Council of the City of Anaheim did adopt Generai
Plan Amendment No. 123 by Resolution 71R-127, changing the general descrip-
tion and extent of land uses and increasing the densities over those
projected in the General Plan adopted by Resolution 69R-644 for the
Anaheim Hills community in accordance with exhibits presented by the land
developers; and
WHEREF~S, the City Council of the City of Anaheim did adopt General
Plan Ame~dment No. 123-A by Resolution 72R-207 covering approximately E52
acres within the Anaheim Hills community changing the general description
and extent of land ~~ses and decreasing the densities from thase projected
in General Plan Amendment No. 123 adopted by Resolution 71R-127; and
WHEREAS, General Plan Amendment 123-A Was intended to be viewed as an
updating of General Plan Amendment No. 123 as it pertained specifically to
the proposed 652-acre planned community area; and
WHEREAS, the original consideration of General Plan Amendment No. 123-A
encompassed only a 652-acre portion of the Anaheim Hills community while the
change in density affected the en'tire 4200 acre parcel; and
WHEREAS, the City Planni~g Commission of the City of Anaheim recomreended
to the City Council o; the City of Anaheim approval of General Plan Amend-
ment No. 123-A as it pertains to the entire 4200 acre parcel; and
WHEREAS, subsequent to the Planning Commission's recummendation of
approval of General Plan Amendment No. 123-A (covering the entire 4200 acre
Anaheim Hills community), and ReclassificaCion No. 71-72-44 (PC, Planned
Community Zone, covering approximately 652 acres within the Rnaheim Hills
community),the City Rttorr~ey informed the Development Services Department
of his concern regarding the legality and enforcement of certain portions
of the existing Planned Community Zone. (The City Attorney felt that the
flexibility and potential lack of uniformity within the Planned Community
Zone would present legal problems. Consequently the City Attorney felt that
rather than approve the PC, Planned Community Zone over an area, some
existing ~ity of Anaheim zone would have to be applied to the specific areas
proposed for development. As a resuit of that determination, it was the
opinion of staff that the best way of handling this situation would ae to
require a zoning plan or element whereby the developer wouid designate at
the outset the City of Anaheim zoning that he intends to apply in implementing
the planned community); and
WNEREAS, the developers of Anaheim Hills propose the expansion of the
boundaries of the planned community which has already been approved by the
Planning Commission and City Council by adding an 18 acre parcel located
west of the Lakeview development and south of the Parkview development as
well as a 5.5 acre parcel located southwest of the Eastridge development and
southeast of the La{:eside development; and
WHEREAS, the City Planning Commission did hold a duly advertised public
hearing in the City Hall in the City of Anaheim, on August 7 end 21, 1972
at 7:30 o'clock P.M., notice. of said public hearing having been duly given
as required by law and in accordance with the provisions of the Anaheim

Municipal Code, to hear and considar evidence for and agains~ said
Amendment to the General Plar., and to investigate and make findings and
recomrnendations in connection therewith, and
WHEREAS, said Commission after due inspection, investigation, and study
made by itself and in its behalf, and after due consideration of all evidence
and reports offered at said hearing, DOES HEREBY FIND
1, That under the eristing Planned Community Zone, property owners
and developers have the alternative of d~signating eir_her City
of Anaheim zoning or having approval of specific site develop-
ment standards for a particular phase or type of development
within the planned community.
2, That in order to alleviate the legal concern expressed by the City
Attorney and to comply with the language of a proposed amend-
ment to the PC Zone, Anaheim Hills, Inc. submitted a zoning
element which designates the City of Anaheim zoning that is to be
employed in implementing the development of each of the specific
areas within the planned community.
3, That Anaheim Hills, I~c., since the August 7, 1972 hearing, has
submitted a revised Zoning Element which has reduced the proposed
zoning from R-S-5000 to R-1, One Family Residential within the
following areas: Area No. 3 within the Northridge development,
the entire Eastridge development, and Area No. 2 of the Lakeside
development.
4. Th ~iidence was presented at said hearings which justifies the
C ~- anning Commission's recommending to the City Council the
inc,~usion of a Zoning Element to designate the City of Anaheim
zones which will be used in implementing the development of the
specifir. planning areas within the planned community.
;, That rather than taking action cn the proposed amendments to the
PC, Planned Community, Zone, the Planning Commission felt that
additional consideration should be given to the subject and with-
held final determination until a later date.
6. That the 23.5 acres proposed for inclusion into the planned
commun;ty area would appear to be a lcgical extension of the
existing 55Z-acre site since it is contiguous to said acreage.
NOW, THEREFORE, BG IT RESOLVED that L•he Anaheim City Planning Commission
does hereby adopt and recommend to the City Council adoption of the Zoning
Element - Exhibit No. 12, and the revised Land Use and Density Element -
Exhibit No. 11, Revision No. 1, on the basis of the foregoing findings.
