A RESOLUTION OF THE CITY PLANNING COMMISSION OF THE CITY Or' ANAHEIM
TI-IAT PETITION FOR VARIANCE PIO. 2434 BE DENIED
WHEREAS, the Cit,y Planning Commission of the City of Maheim did receive a verified Petition for Variance from

MAINTENANCE, 1.1372 Western Avenue, Stenton, California 90680, Agent of certain real
property situated in the City of Anaheim, County of Urange, State of California, des-
cribe3 as Seginning at the intersection of the centerline of Ball Road with the center-
line of Harbor Boulevard; thence Westerly a7.ong said centerline of Ball Road a distance
of 178.00 feet; thence Southerly parallel with the centerline of Harbor Boulevard a dis-
tance of 178.00 feet; thence Easterly parallel with the centerline of Ball Road a dis-
tance of 178.00 feet to the centerline of Herbor Boulevard; thence~Northerly along the
centeriine of Harbor Boulevard a distance of 178.00 feet to the point of beginning; and
WHEREAS, the City Planning Commission did hold a public hearing at the City Hall in the City of Anaheim on
September 6, 1972, at 2:00 o'clock p.m., notice of said public hearing having been duly given as required by law and
in accordance with the provisions of the Anaheim Municipal Code, Chapter 18.68, to hear and consider evidence for and against said
pcoposed variance and tc investigate and make findings and recommendations in connection therewith; and
WHEREAS, said Commission, after due inspecUon, investigation, and study made by itself and in its behalf, and after due
consideration of all evidence and reports offered at said hearing, does find and determine the following facts:
1. Tbat the petitioner requcsts vasitinces from the Anaheim Municipsl Code ea follows:
a, SECTION 18.37.040(B-1) - Maximum number of free-standing aiKna. (1 permi.tted;
3 proposed)
b. SECTIOR 18.37.040('i•1) - Minimum diatance between free-standinQ si~ns. (300
feet required; G5 and 55 feet pro~~oaed)
c. SECTION 18.37.040(II-2) - Minimum heiQht of free-standinQ aiRcis. (8 feet
required; 2 feet proposed)
2. That the Planning Commisaion has consistently denied requests for excessive signing
on other service stations, therefore, since there has been no cha~ge in the Commission's
thinking, subject petition must be denied.
3. That the major oil companies helped to formulate the sigtt ordinance and subsequent
to its adoption, have been the most flagraat violaCOrs.
4. That the oil companies ehould police their facilil-ies to more closely comply with
the sign ordinance.
5. That there are no exceptional or extraordir.~ry circumstances or conditions appli-
cable to the property involved or to the intended uae of the property that do not apply
generally to the property or class of use in the same vici.nity and zone.
6. That the requested v~riance is not neceasary for the preaervation and en~oyment
of a substantial property right possessed by other property in the same vicinity an3 zone
and denied to the property in questiun.

NOW, THER~FORE, BF. IT RESOLVED thet the Aneheim City Plenning Gommisaion does hereby deny subJect
Petitian for Variance on the basis of the aforementioned findinge.
