A RESOLUTION OF THE CITY PLANNING COMMISSION OF THE C1TY OF ANAHEIM
THAT PETITION FOR VARIANCE N0. 2405 BE GRANTED IN PART
1i'HEREAS, the City Planning Commission of the City of Maheim did teceive a verified Petition for Variance from
ALBERT S. TOUSSAU, 3851 East Howe, Piru, California 93040, Owner; SUNBURST DEVELOPMENT,
INCORPORATLD, 9502 Greenwich Street, Anaheim, California 92804, Agene of certain real
property situated in the City of Anaheim, County of Crange, State of California, des-
cribed as Parcel "A", together with the easterly 20.00 feet of Sunkist Street (40.d0
feet wide) adjoining said parcel on ~he west as shown on a map filed in Book 22, Page
20 of Parcel Maps, in the offica of the County Recorder of said county
WHEREAS, the City Planning Commission did hold a public hearing at the City Hull in the City of Maheim on
Seplember 6. 1972, at 7: 30~• .A'clock p.m., notice of said public hearing having been duly given as required by law and
in accordance with t~e provisions of the Maheim Municipal Code, Chapter 18.68, to hear and consider evidence for and against said
proposed variance end to investigate and make findings and recommendations in connection therewith; and
WHEREAS, said Commission, after due inspection, investigation, and study made by itself and in its belialf, and after due
consideration of all evidencc and reports offered at said hearing, does find and determinc the following facts:

a. SECTrON 18.26.050(3) - Minimum lot area. (5850 square feet required;
5 lots with less than 5850 square feet~proposed)
b. SECTION 18.26.050(3)_ - Maximum lot coverage. (35% permitted; 1 lot at
. 36% proposed)
c. SECTIOIQ 18.26.050(S-a-3) - Required distance between s front property line
and a gerage door openinR. (6 to 10 feet or 25
feel• required; 11 to 16 teet proposed on 4 lots)
d. SECTION 18.80.090 - MinimuR livable floor area. (1525 square feet
required; 6 lots propoaed with 1427 square feet
of floor area)
2. That the petitioner withdrew Waiver 1-c, above mentioned, snd stipulated to pro-
viding setbacks in conforuance witti Code and that revised plans would be aubmitted re-
flecting said compliance.
3. That the petitioner atipulated to pr~viding a 6-foot masonry wall along the south
boundary o€ Lot Nos. 29 and 30, and Co provide battin insulation to minimize the noise
from t:sffic that would be emanating from the freeway off-ramp proposed to be constructed
in 1973.
4. That there are exceptional or extraordinary circumatances or conditions applicable
to the property involved or to the intended use of the property that do not apply generally
to the property or class of use in the same vicinity and zone.

5. That the requested variance is neceasary for the preservation and enjoyment of
a substantial property right possessed by other property in the same vicinity and zone
and denied to the property in question.
6. That the requested variance will not be materially detrimental to the psblic
welfare or injurious to the property or improvements in such vicinity and zone in which
the property is located.
NOW, THEREFORE, Bti IT RESOLVED that the Aciaheim City Planning Commission does hereby
grant in part subject Petition for Variance, upon the following conditiona which are hereby
found to be a neceseary prerequisite to the proposed uae of the subject property in order
to preserve the safety and general welfare of the Citizens of the City of Anaheim:
(1) That this variance ia approved subject to the completion of Tentative Tract No.
6931, Revision No. 2.
(2) That this variance is granted subject to the completion of Reclassification No.
71-72-45.
(3) That subject property shall be developed substantially in accordance with plans
artd ~pecifications on file with the City of Anaheim marked Exhibit Nos. 1 through 11 pro-
v4ded, however, that revised plans shall be submitted reflecting that in addition to the
12 lats cu:rently proposed with 25-foot front setback, 8 more lots (Lota 3, 5, 11, 16, 23,
25, 38 and 40) will have 25-foot f.ront setbacks as ~tipulated to by the peCitioner/developez
(4), That a 6-foot iqeaonry wall shall.be constructed along the.south houndary of Lot.
