WHEREAS, the City Planning Commission oF the City of Maheim did receive a verified Petition for Varisnce from

WHEREAS, the City Plannin~ Commission did hold a pu~lic utaring at the City Hall in the Ci.y of Anaheim on
September 18, 1972, at 2:00 ~'clock p.m., notice of said public hearine having been duly given as required by law and
in accord~nce with the provisions of the Anaheim Municipa! Code, Chapter 18.68, to hear and corisider evidence for and against said
proposed variancc and to investigate and malce finding~ and recommenda;ions in connection therewith; and
N'HEREAS, said Commission, after due insp^ction, investigation, and study made by itself and in its behalf, and after duc
consideration of all svidence and reports offered at said hearing, does find and determine the following facts:
1. That the petitioner requests variances from the Anaheim Municipal Cade as follows :

3. That the petitioner stipulated to construction of singie sCOry homes along the
nort~, property line except fcr Lot No. 28, and that Lot No. 28 would have house plan No.
944 constructed on it.
~+. That the petitioner stipulated that where building setbacks were proposed at ten
~eet, chree-car garages with avtomatic garP•~e door openers would be co~:structcd.
5. Tiiat there are exceptinnal or extraordinary circumatances or. conditians applicable
to the groperty involved or tu the intended use, as approved, of the property that do not
apply generally to the property or class of use in the same vicinity and zone.
6, That the requested vaxiance, as approved, is necessary for the preservation and
enjoyment of a substantial pruperty right posseased by other property in che same vi~inity
and zone, and denied to the pro~aerty in q:sestion.
7. That the requested variance, as approved, will not be materially detrimental *_o
the prblic welfare or injcrious to the property or. improvements in such vicinity and zone in
which :he property is located.
8. That one person app'eared, representirg five persons present in the Council Chamber,
ir, opposition to two-story construction along the norL•h property line, and that a petition
signed by eieht persons wes received, also in opp~sition.

NOW, THEREFORE, BS IT RESOLVED that the Anaheim City Plannir.g Cemmission does hereby grant subject
Petition for Variance, upon the following conditions which ~+re hereby found to be a necessary precequisite ;o the pru-
posed use of the sucject property in order to pceserve the sefety and general welfa:e of the Citizens of the City of
Anaheim:
(1) That thi~ variance is grsnted aubject to the complation o:. Reclassification No.
72-73-21 and Tentative Msp of Tract No. 6569, now pending.
