WHEREAS, the Citp Planning Commissior of the City of Anah'eim did receive a verified Petition for Con-

Agent of certain real property sLtuated in the City of Anaheim, Co~nty of C'range, State
of Cali.fornta, described as That portioa of lot 16 of Anaheim Extension as shown on a
mep of Survey made by William Hamel and filed in the office of th~ county recorder of
Los Angeles County, California, a capy of which is ahown in book 3 page 163 et seq.,
entitled "Los Angelea County Mapa", in the office of the county recorder of eaid Orange
County, describeu as followa: Beginning at a point on the center li::e of South Street,
said point being the northwest corner of the land conveyed to Jamee A. Kerwin by deed

on SeptQmber 18, 1972, at Z:00 o~clock P.M., notice of seid public hearing having been duly given
os requiced by law and in accordence with th.a provisions o( ihe Anaheim Municipel code, Chepter 18.64, to henr
nnd consiner evidence for end ugainst said propo<.d conditionel use and lo investiQate and make findings nnd
recommendetions in connection therewith; end
WHEREAS, said Commission, after due inspection, investigation, and study made by itself end in its oe-
half, and aEter due consideration o[ all evidence and repocts o[tered at seid hea~ing, does find and determine the
following facts: .

2. That the petitioner withd:ew Waiver 1-c, above mentioned, and atipulated that
t:he play~round area would be located to the rear of the atracture.
3. That the proposed use will not adversely affect the adjoining lar.d uses and the
growth and development of the area in which it ia proposed to be loceted.
G. That the size and ahape of the aite proposed for the uae is adequate t~ allow
the full developmenc of the proposed use in a manner not detrimental to Che particular
area nor L•o the peace, health, safety aud general welfare ef the Citizene of the City c*t
Anaheim.
5. T'hat the granting of tke Conditional Use Permit under L•he conditions imposed, 1f

6. That the petitioner ettpulated to providing a retaining wall xlong the front
property line where there presently exists only a dirt embonkment,

NOW, THEREFORE, BE IT RESOLVED thet the Anaheim City Plenning Commission does hereby grent/subject
Petition for Cenditionel Use Permit, upon the following conditions which ere heeeby Eound to be a necessary prerequiaite
to the proposed use of the subje?:± property in order to preserve the sa{ety end general welEera of the Citizens of the
City of Aneheim:
(1) TY.at the ow~er(s) of subject property shall pay to the City of Aaaheim the sum of
15 cents per front foot along South Street for tree planting pcrposea.
;2) That the exisring s[ructure shall be brought up to the minimum staadards of the
City of Anaheim, i:~cluding the U:iiform Building, Plumbing, Electrical, Honsir:g, Mechanical
and Fire Codes as adopted by the City of Aneheim,
(3) That tr»sh storage areas ahall be provided in accordance with approved plans on
file with the office of the Director of Public War'~ .
(4) That a six-£oot masonry wall ahall be ~~nstruc..ed along a portion of the weat prop-
erty l.ine sepereting the schooZ play yard area from che R-1 properties to che weot.
(5) That all air conditioning facilities shall be properly shielded from view end the
sound buffered from ad~acent properties.
(6) Thac subject property shall be developed subetantially in accordance with plans and
specifications on file with the City of Anaheim marked Exhibit Nos. 1, 2, 3, and 4 provided,
however, that a retaining wall ahell be constructed along the front property lir,e at,d that
fovr open pArking spaces ehall be provided alon~ the east aide of the school structnce and
that this parking area ahall be improved to eliminate posaible ~ust problems.
(7) ihat Condition Nos. 1, 2, 3, 4, 5 and 6, above mentioned, ehall be complied with
prior to the commencement of the activity authorized under this resolution or prior to the
time that the buil~ing permit ia iasued or within a period of one year from date hereof,
vhichever occurs first, or sucti further time as the Planning Commisaion may grant,
