A RESOLUTION OF THE CITY PLANNING COMMISSION OF 1340CI'fY OF ANAHEIM
THAT PETITION FOR CONDITIONAL IJSE PERMIT NO. BE GRANTED
WHEREAS, the City Pianning Commission of the City of Anaheim did ceceive a vecified Petition for Conditional
Use Permit from LESLIE R. BOATWRIGHT, 319 North Harbor Boulevard, Ar.aheim, California 92805,
Owner; DESSIE SLANKENSHIP, 121 North State College Boslevard, Anaheim, California 92805,
Agent of certain real property situated in the City of Anaheim, County of Orange, State of
Cali.fornia, described as Lots 6, 7 and 8 in Block "A" of Tract No. 423, as per map recorded
in Book 16, Page 30 uf Miscellaneous Maps, records of said Orarge County
; and
WHEREP.S, the City Planning Commission did hold a public hearing at the City Hall in the City of Anaheitn on
October 30, 1972, at 2:00 o'clock P.M., notice of said public heacing huving been duly given as required by
law and in ecrnrdance with the provisionc of the Aneheim Municipal code, Chapter 18.64, to hear end consider evidence
for and agaic.st said proposed conditional use and to investigete and make findings and recommendetions in connection
therewith; and
WHEREAS, said Commission, after due inspection, investigetion, and study made by itself and in its behalf, and
efter due consideration oE ell evidence and xepocts ofEete d at said hearing, does find end detecmine the fallowing Eacts:
1. Thet the proposed use is properly one for which a Conditional Use Permit is authorized by Code SecCion.
18.64.02~(1-c) co wit: establish a church in an existing residence with waivers of:
a. SECTION 18.28.050(6-a-1) - Minimum frcr~L yard. (20 feet requir.ed; 9.5 feet
~ proposed)
b. SECTION 18.04.090 2-a - Parkirg area locati~n. (Parking in the front and
side yards not permiCted; front and side yard park-
ing ar.ea proposed)
2. Tnat waivers 1-a and 1-b, above ;nentioned, are hereby qrarited as of£-streeC parking
is necessary due to the fact that Harbor Boulevard has parking restrictio^s and the adjacent
vacant lot is thus proposed to provide for said off-street parking.
3. That the proposed use wil] not advecsely effer,t. the adjoining land uses end the gtowth end development uf
the erea in which it is proposed to be located.
4. That the size and shape of the site proposed for the use is adequate to ellow the full development of t!ie
ptoposed use in a manner not detrimen[al to the pacticular area nor tu the peace, health, safety, and general welExre of
the Citizens oE the City of Anaheim.
5:. That the granting of the Cond;tiona( !.ise Pecmit under the conditions imposed, if nny, will not be detrimental
to the peace, health, safety, and general weltate oE the Citizens of the City of Anaheim.
6. That t':e proposed use shouSZ be granted for a period of. five (5) years to determine
if any increase in menibership will a~fect the proposed p$rking.
7. That the pelitioner stipulated that V~~ had a reciprocal parking agreement ~:~ith
St. Catherine`s Military Academy for s~ny overflow parkin.g that mighc occur in the church.

NOW, THECr~FORE„ BE IT RESOLVED that the Anaheim Ciry Planning Commission d~es hereby
grant subject Petition for Conditional Use Permit, upon the following conditione which are
hereby found to be a necessary prerequisite to the proposed use of the subject property in
order to preser~•e ttie safety and general welfare of the Citizens of the City of Anah.eim:
(1) That the owner(s) of subject property shall deed to the City of Anaheim a strip of
land 45 feeC in width frnm the centerline of the street along Harbor Boulevard for street
widening purposes and a strip of lanZ 1~^. feet in width from the centerline of the s12ey along
the alley west of subject property for alley widening purposes.
(2) That the owner(s) of aubject property shall either obtain an encroachment permit
frum the City of Anaheim for the existing 6-foot high wall located in the ultimate right-of-
~ay of the all.ey or relocate the wall so that it does not encroach.
(3) That trash storage areas shall be provided i.n accordance with approved plans on
file with the office of the Director of Public Works.
(4) That any parking arealighting proposed shall be down-lighting o_` a maximum height
of 6£eeC, which lighting shall be directed away from the property lines to protect the resi-
dential integrity of the area.
(5) That the existing str.ucture shall be brought up to the minimum etandarda of the
City of Anaheim, including the Uniform Building, Plumbing, Electrical, Housing, Mechanical
and Fire Codes as adopted by the City of Ananeim.
(6) That the vehicular access rights,except at slreet and/or alley openinga, to Harbor
Boulevard shall be dedicated to the City of Anaheim except that the northerly acceas along
Harbor Boulevard shall be allowed to remain open to pr.ovide access to the garage Co be used
by the resident priest unlesr~ the City Engineer deteXCnines that due to traffic problema, said
driveway acceas should be c2osed.
(7) That subject property ahall be developed substantially in accordance with plans and
specifications on file with the City of Anaheim marked Exhibit Nos. 1, 2, 3, 4 and 5.
(8) That Condition Noe.•1,•2, 3, 4, 5, 6 and 7, above menEioned, 'sha1l'be~complied with
prior to the commencement of the activity authorized under this resolution, or prior to the
time that the building permit is isaued, or within a period o~ one yeat from date hereof,
whichever occurs first, or such further time as the Planning Commission may grant.
