A RESOLUTION OF THE CITY PLANNING COMMISSION OF THE CITY OF ANAHEIM
THAT PETI'TION FOR VARIANCE N0. 2450 BE. GRtSNTID
WHEREAS, the City Planning Commission of the City of Anaheim did receive a verified Petttion for VarIance from
STEPAN: CHEMICAL COMPANY, 1211 North Olive Street, Anaheim, Califarnia 82801, Owner;
INDUSTRIAL PALLET COMPANY, Post Office Box 2291, Westminster, Celifornia 92683, Agent
of certain real property situated in the City of Anaheim, County of Orange, State of
Cali'fornia, described as The southerly 250 feet of the following deacribed property:
Beginning at a point in the center line of Patt Street 227 feet South of the North-
crest corner of the South half of the Northwest quarter of the Southeast quarter of
Section 3, Township 4 South, Range 10 Weat, in the Rancho San Juan Cajon de Santa Ana,
as ahown on a map recorded in book 51, page 10, Miacellaneous Maps,~ recorde of Orange
County, California., being a point in the Westerly extension of the Southerly line of
Cormnercial Street, ~s said street ia described in the deed to the City of Anaheim
Recorded December 29, 1927 in book 111, pagE 475, Official Recorda, running thence
Easterly along the Southerly line of Commercial Street and the extenaion thereof 505
feet to the West line of Olive Street, as described in the deed to the City of Anaheim,
recorded May 27, 1938 in book 943, page 122, Official Recorde, thence Southerly along
the West line of said Olive Street 1092,15 feet to the South line of the North ha1,4 of
the Southwest quarter of the Southeast quarter of said Section 3, which line is also
the North line of the Shaffer-OawaliiSubdivision, as shown~'on a map recorded in book 7,
page 41, Miscellaneoue Mapa, records of Orange County, California; thence West along
the South line of the said North half of the Southwest quarter of the Sontheast quar-
ter of said Section to the center line of Patt Street; thence North along said center
line of Patt Street to the.point of beginning; and
WHEREAS, the City Planning Commission dId hold a public hearing at ihe City Hall in tha City of Maheim on
I3ovember 27, 1972, at 2:00 o'clock p.m., notice of seid public hearing having been duly given as requtred by law and
in accordance with 4he provlsions of the Anaheim Municipel Code, Chapter 18.68, to hear and consider evidence for and against said
proposed variance and to investigate and make findings and recommendations in connection therewiUi; and
WHEREAS, seId CommissIon, after due inepectlon, investlgation, and study meda by itself and in its behelf, and after due
consideraUon of all evidenca and reports offered at said hearing, does find and determina the following fac[s:

2. That there are exceptional or extraordiuary circumatancea or conditions applicable
to the property involved or to the intended use. of the property that do not apply generally
to the property or class of use in the same v3.cinity and zone.
3. That the requested variance is necee,sary for the prezservation and enjoyment of a
~eubatantial property right posaeased by otl.er property iu the same vicinity and zone and
denied to the property in queation.
4. That the requested variance wil7, not be materielly detrimental to the public wel-
fare or injurioua to the property or improvementa in such vicinit;~ and:zbne 3h-•whtch the
property i~ located.
5. That the petitioner atipulated to providing redwood slat•t-Ed chainlink fence on
the east, south and west property linea to protect the residential environment from noiees
and dust emanating from the proposed operation.
6. That the petitioner etipulated that houra of operation would be from 8:00 a.m, to
4:30 p.m.; and that no night work would be performed.
7. That the petitioner stipulated that palleta will not be atacked higher than the
six-foot high fence. '
NOW, THEREFORE, BE IT RESOLVED that the Anaheim City Plenning Commiasion doea hereby
grant subJect Petition for Variance upon the following conditione which are hereby found
tfl be a necessary prerequisite to the proposed use of the subject property in order to
preserve the safety and general Welfare of the Citizene of the City of Anaheim:
(1) That a chainlink fence with redwood slats shall be provided along the east, south
and west property•linea as stipulated by the petitioner.
(2) ThAt all pallets shell be atacked no higher than six feet e~ etipulated to by the
petitioner.
(3) That the unpaved area of subject property ahall be treated with dust retardant
materials to reduce the duat emisaion from the proposed use.
(4) ThaC the houra of operation ehall be from 8:00 a.m, to 4:30 p.m. ae stipulated
by the petitioner.
(5) That there ehall be a one year time limit for the propoaed use, with an option to
request an additional one yeer exten8ion of time, qince the petitioner stipulated thia
would be a temporary location for thie operation.
(6) That any exterior lighting ahall be directed away from the residentiel parcele
to the south.
(7) That subJect progerCy ehall be developed substantially in accordance with plana
and epecificati,onB on file vtith the City of Anaheim marked Exhibit Nos. 1 and 2 provided,
however, that'i~gdwood alata shall be placed in the chainlink fence along the eaet, eouth,
and west prope~s.'Lq lines.
