WHEREAS, the City Plenning Commission of the City aE Anaheim did ceceive a verIfled Petition for Conditionel
Use Pennit from BURGL~R CHEF SYSTEMS, INCORPOFtATED, 1348 West 16th Street, Indianapolis, Indi-
ana 46202, Owner; B.W. WATTERS, 1118 Highland Drive, Newport Beaah, California 92660, Agent
of certain real property situated in the City of Anaheim, County of Orange, State of Cali-
fornia, described as That portion,of the Southeast quarter of the Southeaet qusrter of

WHEREAS, the City, Plenning Commission did hold a public hearing et the Ciry Hall in the City of Anaheim on
November '27, 1972, et 2:00 o'clock P.M., notice of seid public hearing having been duly given es requ.ired by
law end in eccordence .+ii;: the provisions of the Anehelm Municipel code, Chepter 18.64, to heer and conslder evidence
for end egeir.st said proposed ~ nditional use end to investigete and ~eke findings and recommendetions in connection
therewith; end
WHEREAS; seld Commission, after due inspection, investigetion, end study mede by itselE end in lts behalf, and
after due consideretion of all evidence and ceports offered at said hearing, does find end detecmine the following fects:
1. Thet the proposed use is propecly one for rvhich a Conditianel Use Permit is authorized by Code
Section 18.40.060(g) to wit: permit on-sale beer in conjunction with the aerving :F food
in a proposed reataurant.
2. That the proposed use wlll not adversely eEfect, the adf olning lend uses and the growth end development of
the erea in whlch it is proposed to be lccated.
3. Thet the size and shape of the site proposed fot the use ls adeq¢ate to ellow the full development of the
pmposed use in a menner not detrimental to the per4culer area nor to the peace, health, sefety, end general welEece of
the CiEizens of the City of Anaheim.
4. Thet the gcenting of the Conditionel Use Peemit under the conditlons imposed, if ony, wlll not be detrimental
to the peace, health, safety, end generel welfare of the Cttizens of the City of Maheim.

NOW, THEREFORE, SE IT RESOLVED that the Maheim City Plenning Commission does hereoy grant aubJect
Petition for Conditionel Use Permit, upon the following condidons which ere hereby found to be e necessery pcecequisite
to the pcopased use of the subject pcoperty 1n order to preserve the sefety end general welfeie oEthe Cltizens of the
City oE Anaheim• ,
(1} That trash storage areas snall be provided in accordance with approvad plans on
file with the office of Ehe Director of Public Worka.
(2) That all air-conditioning facilities ahall be properly ehielded from view, and
the sound buffered from adjacent propertiea..
(3) That a parcal map to record the approved division of subject property be submitted
to and approved by the City of Anaheim and then be recorded in the office of the.Orange County
Recorder.
(4) That subject property ahall be aerved by underground utiliCies. •
(5) That appropriate water asseasment fees as determined by the DirecCor of Peblic
Utilities ahall be peid to the'City of AnaHeim prior to the iasuance of a bui.lding permiE.
(6) That the final parking plan shall be approved by the Development Servicea Tiepart- .
ment and any landacaped areas in the parking area ahall be protected with 6-inch high con-
crete curbs, and concrete wheel stops shail be provided for parking'spacea as iequired by
the Develo~aent Services Departm~snt. '
(7) That eubject property shall be developed aubetantially in accordance with plans .
and apecifications ori file with the City of Anaheim ma=ked Exhibit Nos. 1, 2, and 3.
(8) That Condition~Nos. 1, 2, 3, 4 and 6, above mentioned, shall be complied with.
prior to final building and zoning inepections.
