A RESOLUTION OF THE CITY PLANNING COMMISSION OF THE CITY OF ANAHEIM
RECOMMENDING TO THE CITY COUNCIL OF THE CITY OF ANAHEIM THAT
PETITION FQR RECLASSIFICATION NO. ~l"~2"32 BE APPROVED
WHEREAS, the City Plenning Commisston of the City of Anaheim dld receive a veriEied Petition for Reclassifice-
tionf:om DONN C. GILMORE and TARIQ M. SHAMMA, 2229 East'Lincoln Avenue, Anaheim, California
92806, Owners of certain real property situated in the City of Anaheim, County of Orange,
State of California, described as Lot No. 5 and Westerly 6.57 fee~ of Lot 4 of Tract No.
1843

WHEREAS, lhe City Plenning Commission did hold a public headng et the Clty Hell ln the City of Anaheim on
March 6, 1972, et 2:00 o'clock P.M. notice of seid publlc heering heving been duly given as requlred by
lew and in accordence with the provisions of the Ane!~elm Municipel Code, Chepter 18,72, to heer and conslder evidence
for end egeinst said proposed reclassificotion end to investigete and make findings and recommendetlons in connection
therewith; and
WHEREAS, seid Commission, e(ter due lnspection, investigetion, and study niede by Itself end in ite~ bchelf, end
efter due consideretion of el! evidence end repods offered et seld hearing, does find and dntermine the following facts:
1. That the petitioner pruposes e reclaseificetlon of the ebove descrtbed property from the R-1. ONE PAM~LY
RESZDENTIAL, ZONE to the C-0, COMMERCIAL OFFICE, ZONE.
2. That the proposed reclaseification ie in conformaitce with the General Plan.
3, That the proposed reclassiEtcetion of aubject property !s necessery end/or desireble for the orderly end pro-
per development oE the eommunity.
4. Thet the propased reclessiEicetion oE eubJect property does properly relete to the zor.es end their pecmitted
uses loccilly established in close proximity to subject property and to the zones end their permltted uses generally esteb~
lished thcoughout the community.
5. That the proposed reclassification of subject property requiree the dedication
and improvement of abuCting streeta in accordance with the Circulation EleQent of the General
Plan, due to the anticipated increase in traffic which will be generated by the inteneifica-
tion of land use.

NOW, THEREFORE, BE IT RESOLVED that the Anehaim City Planning Cocunission does hereby
recommEnd to the City Council of the City of Anaheim that subject Petition for Reclassifi-
cation be approved and, by so doing, that Title 18-Zoning of the Anaheim Municipal Code be
amended to exclude the above described property from the R-1, ONE FAMILY RESIDENTIAL, ZONE
and to incorporate said described property into the C-0, COMMERCIAL OFFICE, 20NE upon the
fullowing conditions which are hereby found to be e necessary prerequisite to the proposed
use of aubject property in order to preaerve the safety and general welfare of the Citizens
of the City of Anaheim.
(1) That the owners of subject property shell deed to the City of Anaheim a strip of
land 53 feet in width from the cer.terline of the street along Lincoln Avenue for street
widening purposes.
(2) That the owners of subject property shall pay to the City of Anaheim the sum of
$2.00 per front foot along Lincoln Avenue fur street lighting purposea.
(3) That the owners of aubject property shall pay to the City of Anaheim the sum of
15p per front foot along Lincoln Avenue for tree planting purposes.
(4) That all vehicular access rights to Lincoln Avenue shall be dedicated to the City
of Anaheim,
(5) That the damaged and/pr hazardous sidewalks shall be repaired along Lincoln Avenue
as required by the City Engineer and in accordance with standerd plans and specifications on
file in the office of the City Engineer,
(6) TneL• trash storage areas shall be provided in accordance with approved pians on
file with the office of the Director of Public Works.
(7) That a six-foot masonry wall shall be constructed along the east and west property
lines provided, however, that a bond in an amount and form satisfacto:-y to the City of Ana-
heim may be poated with the City to guarantee installation of eaid walls within a period of
two years.
(8) That all air conditianing facilities ehall be properly shielded from viesr,:and the
sound buffered from adjacent properties.
(9) That subject p°operty ahall be served by underground utilitieo.
(10) That the existing structure shall be brought up to the minimum standards of the
City of Anaheim, including the Uniform Building, P7.umbing, Electrical, Housing, Mechanical
and Fire Codes as adopted by the City of Anaheim.
(11) That any parking area lighting proposed shall be down-lighting of a maximum height
of six feet:, which lighting shall be direcCed away from the property lines to protect the
residential inCegrit; of the area.
(12j Prior to the introduction of an ordinance rezoning auoject property, Condition Nos.
1, 2, 3, 4, and 7, abc,ve mentioned, shall be completed. The provisions or rights granted by
this resolution shall become null snd void by acl•ion of the City Council unless said condi-
tions are complied with within 180 days from the dete hereof or euch further time as the City
Council may grant.
(13) That Condition Nos, 5, 6, S, 9, 10 and 11, above mentioned, shall be complied with
prior to final building and zoning inepections.
THE FOREGOING RESOLUTION is aigned and approved by me this 16th day of March, 1972.
