A RESOLUTION OF TSE CITY PLANNING COMMISSION OF THE CITY OF ANAHEIM

WHEREAS, the City Plenning Commisaion of tha City of Anaheim did receive e vecified Petition for Vecience from
JERRY D. NILSSON, M.D., 1720 West Ball Road, Anaheim, Cali£ornia 92804, Ownpr;
CHARLES A. ROSS, 4868 Gondar Avenue, Lakewood, California 90713, Agent of
cer*_ain real property situated in the City o£ Anaheim, County of Orange, State
of California described as the South 96 feet of the North 481 feet of the East
iialf of thc- Evat half of the Southeast quarter of the Southeast quarter and the
5outh 96 feet of the North 481 feet of the East 8 feet of the West half of the
East half of the Southeast quarter of the Southeast quarter of Section 14, in
Township 4 South, Range 11 West, in the Rancho Los Coyotes, as per map recorded
in Book 51 Page 11 of Diiscellaneous Maps, in the office of the County Recorder
of said county. EXCEPT that portion thereof conveyed to the State of California

WHEREAS, the City Planning Commisaion did hold a publlc hearing at the City Hell in the City of Aneheim on
Ap ri 1 3, 19 72 , et 2:00 o'clock P.M., notice of said public hearing heving been duly given es required by
lew and in accocdence wlth the provisions of the Aneheim Municipal Code, Chepter 18.68, to hear end consider evidence Eor
and against seid proposed varience end to investigete end make findings end recommendetions in connectian therewlth;
and
WHEREAS, eaid Commission, efter due inspection, investigation, and study mede by itself and in its behelf,
and eEter due consideretion of all evidence and repotts offered at seid hearing, does find end determine the following
facts:
1. Thet the,petltione: requests e verience from the Anehelm Municipal ~Code as folloWS:
a. SECTZON 18.40.070(2-a-5-a - Minimum side setback.. (10 feet required; 0 feet
proposed)
b. SECTION 1$.40.070(6-a) - Residential zone boundarv screenin~ r.equirements.

2. That Waiver 1-c, above mentioned, iB hereby denied on the basis that the pronosed

3. That Wai.vere 1-a, 1-b, and 1-d, above mentioned,are hereby granted on the baeis L•hat
the adjoining R-A residential property is developed with either a motel or commercial usea,
therefore these requirements would appear tu be inappropriate.
4. That there are exceptional or extraordinary circumstances or conditions applicable to
the p:•operty involved or to the intended uee, as approve~ of the property that do not apply
generally to the propQrtp or class of use in the same vicinity and zone.
5. That the requeated variance, ar epproved, is neceas9ry for the preservation and en~oy-
ment of a~ubstantial property right ponsesaed by other property ir the same vicinity and
zone, and denied to the properl•y in question.
6e That the requested varience, as approved, will r.ot be msterially detrimental to the
public welfare or injurious to the property or improvements in such vicinity and zone in
which the property is locaCed.

NOW, THEREFORE, BE IT RESOLVED that the Anaheim City Planning Commission does hereby gcent~subject
Petition for Variance, upon ihe following conditions which ace hereby found to be a necessary prereqaisite to the pro-
posed use of the subject p:operty in order to preserve the safety and generel welfece oE the Citizens of the City of
Anaheim:
(1) That this Variance ia granted subject to the completion of Reclassificatzon No,
71-72-35, now pending.
(2) That aubject property shall be developed substantially in accordance with plans
an' specifications on file with the City of Anaheim marked Exhibit Nos. 1, 2, 3 and 4.
